The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Transmissions on this particular car as on the other cars are managed by their own control module which decides when and under what conditions to shift gears. We did not diagnose this particular car, we got the transmission from other shop as a stand alone unit, which we rebuilt to OEM specs. But after the transmission was installed by other shop we were told that transmission won't shift correctly. We performed a relurn procedure and were told that was shifting OK! We also advised the other parties to check the electrical part, including the transmission control module. Recall we did not diagnose the vehicle and powertrain, we just rebuild the transmission!! Couple of weeks later the car was brought to our shop with transmission problems. I tried to establish the communication with the computer with our SNAP-ON Scanner, but the transmission computer woud throu communication error!! As a courtesy to the customer I told him that I will rebuild the transmission again only on the condition he would fix car's electrical and computer errors. As per invoice 130212 for this rebuild only in the parts it cost us more than $2000.00. Again the car was brought to us couple of weeks later with shifting problems!! The electrical and computer problems were not fixed!! I told the customer that I will overhaul the tramsission at my own expense last time and he needs to fix his electrical and computer problems and our customer manager wrote all this down on the invoice #130249. I am sorry for this misfortune, but I believe we did everything possible to solve the issue!!
