Statement of Claim
Claimant says:
"Complaint of theft and fraud.
On September Mr. Darin Danielo of Ai Automatics fraudently Billed my Discover card an unauthorized amout of $757.00 plus dollars. I only authorized him to bill $197.00 totalo my credit car . I authorized the payment of a verbal bill of $e127.00 for towing a vehicle a couple of blocks and a $70.00 evaluation of the vehicle fee.
The vehicle is not owned by me. I had donated it to the National Public Radio Station. and they are the sole owners of the vehicle and its title. National Public Radio Officials have on multiple times contacted Mr. Damileo to release their vehicle to him and he has verbally abused and threatend Lori a clerk in their office in bend Oregon and he physically threatened a tow truck driver this morning from the Colorado Auto Auction who was instructed to pick up their vehicle by National PubLic Radio. I spoke to Mr. Damileo on the telephone last week upon being called by officials from National Public Radio regarding his irration, bizarre behavior and threats of physical violence. At the time Mr. Daileo threateed me with bodily harm over the phone. I called himj back and told him I didn't want to argue or fight with him and he said I should send him a check for his total verbal bill wihich amounted to $197.00. I told him I would send the check upon reciept of an itemized bill from him. He has never supplied any bill. His behavior today contistutes theft and fraud and I have made the necessary reports of his theft to both The Town of Trinidad Police Department and The Las Animas County Better Business Burea. The gentleman is running a scam and attempts to take advantage of indibvidual travelling along Highway I25 as this is a rather remote area and there is a dearth of service providers. Upon donating the vehlicle I itemized items that I left in the vehicle and this list was furnished to NMPR along with the keys and title to the vehicle. Mr Damileo removed and subsequently " stole" tools, new auto parts for the vehicle and my golf clubs and bag from the vehicle.Items totalling more than $1500.00 in value. At the same time Mr. Damileo who claims to be a Geico Insurance provider has turned in bills to the insurance company for $127.00 attenmpting to recieve yet more undue compensation for towing the vehicle a couple of blocks. Any charges beyond the authorized amount of $197.,00 are in fact fraudulent and constitute theft on the part of Mr. Damileo. As I said before, Mr Damileo is a scam artist. He basically atempts to keep the vehicles of those he services. My understanding is that there are multiple complaints against Mr. Damileo both for theft, fraud and his objectionabl threatening behavior. I demand A return of The $575,00 that he fraudulently billed my Discover card plus due compensation for the items he removed, namely stole from my vehicle"
