Statement of Claim
Claimant says:
"Dear Sir:

On 5-28-2012 which was a holiday, I call on a 1991 Nissan Mini Pick up to a Ramon and Roberto Carlos-Almanza that both of them work at Affordable Auto Sales 3216 Q St.Omaha, Nebraska. When I pulled up about 7 Mexican men came out of the garage, and stood out side the building watching us.. I tried to look at the vehicle and started it.. I wrote the check to Roberto, Due to Ramon , Roberto said did not have a banking account .
I was told by both that they drove it back and forth to Des Moines every day to work and that there was nothing wrong with it other than the speed-o-meter was broken. (My mechanic told me later, that someone tried to turn the mileage back on this vehicle) After driving it, I noticed that it had a shimmy in the back. I looked under the hood, but did not see anything. I wrote a check for $1200.00 and drove it home. I took it to my mechanic the next morning and he put it up on the rack and found that both engine mounts were broken, and tied up with nylon cord. The transmistion mount was also tied up with a nylon cord. The Mechanic told me that I was lucky to have not had a wreck, and was killed with all that was wrong with the vehicle. He gave me a list of problems with the vehicle to the total of $2160.60 just to make it SAFE.

I called the Omaha, Nebraska Police to have them meet me at the dealership to have two wittnesses that I had returned the vehical with in the 72 hours limit on the sale.

I talked to the owner of the Car lot, and he told me that he would contact Roberto Carlos-Almaneza and have him call me.

The owner of the dealership, put the date of me buying the vehical.. which was not the date that Juan Garcia sold the truck to Roberto.. which was forgery, and Ramon saying that he was Juan Garcia was not true.

Since that time, I have tried to call Mr. Almaneza and Ramon several times, and one of them said, TAKE ME TO COURT!.. I told him I just wanted to bring the vehical back (by tow truck) and get my money and go one with life. He has not returned my phone calls.. One of the guys said that he was Juan M. Garcia of 1541 Berry Ave., Omaha, Nebraska. Which was not true. I have written a letter to Juan Garcia and he called me and through his daughter transilated what we talked about. He told me that Roberto bought the vehical for $600.00 and he would call and talk to him. He did not want any problems,.

I tried to return the vehical with in 72 hours, in any business deal.

I just want my money back and they can have the vehical back.. I will even pay for the hauling of the truck to them.
