Claimant says:
"I RENTED A 10 SEATER LINCOLN LIMO WITH ALL STAR LIMO ON 10/21/12. I TOLD THE OWNER WHEN I BOOKED THE LIMO THAT I HAD NINE GUESTS. HE SAID THE 10 SEATER WOULD ACCOMODATE MY GUESTS AND ME COMFORTABLY. THE PRICE WAS RIGHT SO I BOOKED IT FOR 4 HOURS AND GAVE $100 DEPOSIT. FIRST PROBLEM: MY GUESTS DID NOT FIT IN LIMO COMFORTABLY IN FACT I HAD TO SIT ON THE FLOOR. THE OWNER DID NOT SAY ALL MY GUESTS HAD TO BE SIZE 3. THE LIMO DRIVER SAID THAT USUALLY WITH 10 PASSENGERS THE OWNER WOULD HAVE RECOMMENDED A MUCH LARGER LIMO BECAUSE PEOPLE NEED MORE SPACE THEN WHAT 10 SEATER OFFERS...USUALLY FOR 6-8 PASSENGERS. I DID HAVE A CONVERSATION WITH THE OWNER ABOUT RENTING A LARGER LIMO BUT THAT WAS BECAUSE I HAD A COUPLE OF MORE PEOPLE WHO WANTED TO JOIN THE PARTY NOT BECAUSE HE SAID IT MAY NOT BE COMFORTABLE FOR MY 9 GUESTS. I DECIDED AGAINST A LARGER LIMO BECAUSE AN ADDITIONAL $300 WAS NOT WORTH IT FOR 2-3 MORE PEOPLE ESPECIALLY SINCE IM PAYING THE COSTS. WE WENT AHEAD AND BOARDED THE LIMO BECAUSE WE HAD ALL PAID FOR TICKETS TO AN EVENT THAT WAS IN 30 MINUTES. NO TIME TO DRIVE AND PARK OURSELVES. SECOND PROBLEM: THE RADIO HAD WIRES HANGING FROM IT AND COULDN'T BE HEARD IN FRONT OF LIMO. THIRD PROBLEM: THE AC ONLY BLEW FROM FLOOR AND IT WAS VERY WARM...ALSO THE WINDOW WAS STUCK AND WOULDN'T ROLL UP OR DOWN. FOURTH, THE WINE GLASSES HAD LIPSTICK STAINS ON THEM. FIFTH, THE TIRES MADE A BUMPING SOUND AS WE TRAVELED. FIFTH, THERE WAS THIS BURNING RUBBER SMELL WHICH COULDN'T BE EXPLAINED. SIXTH, THE DRIVER DEMANDED THE REMAINING BALANCE WHEN HE PICKED US UP AFTER MY EVENT, IN FRONT OF MY GUESTS AND WORK ASSOCIATES. SEVENTH, THE DRIVER SAID HE WAS PISSED AND REFUSED TO CALL THE OWNER WHEN I SAID I WAS NOT SATISFIED WITH THE SERVICE AND DID NOT FEEL THAT I SHOULD HAVE TO PAY $260.00. ALSO SAID HE SHOULD HAVE GOT MONEY FROM ME UP FRONT CAUSE NOW HE WAS GOING TO BE IN TROUBLE WITH OWNER.
EIGHT, I HAD TO SPEND $135.00 TO HAVE A TAXI SHUTTLE MY GUESTS BACK TO ORIGINATING DESTINATION BECAUSE NO ONE FELT SAFE OR COMFORTABLE IN THE LIMO. NINTH, THE OWNER CHARGED MY CREDIT CARD $260 WITHOUT AUTHORIZATION ALTHOUGH MY GUESTS AND I DID NOT RIDE BACK IN LIMO DUE
TO SAFETY CONCERNS. TENTH, THE OWNER REFUSES TO GIVE ME ANY OF MY MONEY BACK AND FEELS THAT NOTHING WAS WRONG WITH HIS LIMO"

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "We have contacted local law enforcement and are filing a criminal complaint against Kim Smith for "Defrauding an Inkeeper" CA Penal Code 537 She used our service and did not want to pay. All her claims are not true and are only excuses to not pay for services rendered. Several people in her party are very big in statue. California Highway Patrol determains seating seating capacity and she reserved a ten passenger limousine. She was upset when we arrived because her group did not fit. This is out of our control. The wire hanging from sound system is a ipod/mp3/iphone connection cord. She stated that car was making a thumping sound an was not safe. That is not true. Because her groups statue and weight, the limousines shocks were bottoming out and rubbing. We charged her credit card and will let the credit card compaines work it out. "
