Statement of Claim
Claimant says:
"I turned in my 2011 Chevrolet Malibu car on a lease on Jan. 3, 2014 to my local dealer, Fox Automotive, and it sat in the deep snow at the dealership for about 10 days before Ally Financial picked it up then they inspected it. I asked that the car be inspected when I turned it in (during a snow storm) and was told "It will be alright".

Then Ally is coming back to me to pay them $354.46 (out of over $600 they say it really costs for repair) for a scratch we do not know was on it when it was turned in. The Dealer, who has had problems with Ally before, sent them a letter stating, "...at lease turn in was not present" but Ally is disregarding that. Ally keeps calling me to pay or they will send this to the credit bureaus. I keep telling them it is not my fault and the vehicle was OK when I turned it in. They have no proof that it was there at that time. It must have happened after turn-in.

I do not feel they have a right to charge me when the car sat at the dealer in deep snow and was not inspected at the dealership when it was turned in. AND this is the second time this has happened with Ally. I think the car should have been inspected at the time I turned it in or they should "take it as it is". I have been dealing with Ally about this since February. They have now offered me a deal at $248.00. I said I would pay them $100.00 only to stop their harassment. They are disregarding the dealership letter and can say anything happened after turn in and charge me for it.
