Claimant says:
"Apex Plumbing was operating pursuant to a permit with Denver Wastewater in the 1100 block of the alley between Madison Street and Monroe Street on April 20 2012. Their "Road Closed" sign was permitted to be in the ally only to close off the all access. It was not permitted to ber in the street right-of-way. It was protruding into the right-of- way of 12th Avenue on the north end of the alley and fell against my wife's vehical which was in the street right-of-way on 12th Avenue, damaging the vehical. I have tried repeatedly to contact Apex Plumbing, but cannot get a response from the owner."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Mr. Jehn's wife ran her car into our sign, which was lawfully placed. She called the police and they would not cite us despite her insisting they do so. The reason we were not cited was because she caused the accident. Our supervisor on site told the police we did not want her to get a ticket. The collapsible road sign is expensive but we decided not to pursue money for replacement as a gesture of goodwill, to which she was and (clearly) is not entitled. Our sign did not just fall into her vehicle, she ran into it. Mr. Jehn called several times and has harassed and cursed at our office staff. He was informed at the time of the accident and every time since, that we are not responsible for damage we did not cause. We are the injured party and he knows it. His wife's car is in need of a paint job - we have several pictures - and he apparently wants us to pay for it. To demand that we pay for the damage Mr.Jehn's wife caused is just wrong."
