Statement of Claim
Claimant says:
"I had filed a claim on behalf of my Mom who passed away this past January 2014. Beginning February first, my wife and I began emptying her property located at 30 Myona Street, in Methuen, MA. We worked in the house for several months. Upon entering the home on the 4th of April,(A Friday Evening) we came to find the basement flooded. It was a finished basement at the time and we were (2) days away from listing the property for sale. My spent the night and the entire weekend, Shop Vacs, Dehumidifier, and push brooms in an effort to dry the basement. I reported the claim the following week, to T.A. Sullivan Insurance located on Merrimack Street in Methuen. Sullivan was my Mothers agent and Arbella was the carrier. It took a week, for an adjuster to come out to the property to asses the damage caused by the flood. The cause of the damage turned out to be clogged drains caused by tree roots. Roots had infiltrated both the sewer drain and ground water drain. The clogged drains had been determined by the Plumbing and Heating co., Kannan and Pricone out of Methuen. They did not have sufficient equipment, that would allow them to clear the drains out to the road. Drains by James was the contractor that charged us $1,400.00. I included the $1,400.00 as part of the initial insurance claim, and it was denied by Arbella. Arbella indicated that it was considered general maintenance, which is the responsibility of the homeowner to insure that the drains are serviced regularly. I reminded them that the homeowner had been hospitalized (My Mom) on December 12, 2013 and passed away on January 15, 2014 she was 85 years old. She was alone in the house for the last 25 years, after my Father died. Let me remind you that house was vacant for 4 months leading up to the Insurance claim. When I told Arbella that Mom had passed away, they immediately canceled her home owners policy, even though I was making payments. The reason being that the conditions of the policy had changed. My Mom had died. Very sympathetic weren't they.) I'm looking to recover the $1,400.00) I paid out of pocket to have the cause of the damage repaired. Arbella paid $23,000.00 to replace the downstairs. and reimburse us for personals that were lost, but wouldn't reimburse us the $1,400.00 it cost me to insure that the new homeowner would have the same problem. Thank You."

  • Claim Number #033449929 Grace Ronsivalli (Deceased January 15, 2014) Paid for the replacement damage of the basement $21,300.00 but wouldn't reimburse me the $1,400.00 out of pocket expense that was paid to resolve the cause of the damage. I was preparing the property to sell, when this incident occurred. No one had been occupying the property since Decmber 12 of 2013 when my Mom was admitted to Winchester Hospital for surgery. There was no indication prior to her death that there was a problem, (ex. water slow to go down the drain, toilet backing up or slow when flushed) or I would have heard from her. Mom was 84 years old but as sharp as could be and still drove. Arbella classified the cleaning of the drains the responsibility of the homeowner. Well, the home owner had been in the hospital four months prior,
    and never returned home. The cause of the blockage was that roots had entered the drains from the street, and it was nothing that Mom did or didn't do anything to cause the blockage. Shame on you Arbella.

  • I received a call from Arbella Insurance Regarding my claim and guess what, For the fifth time, I heard that maintaining of the house drains is the responsibility of the homeowner. What he and several others seem to turn a blind eye to, is that the homeowner being my Mom, passed several months prior to the event, leaving the property empty she was 85. She had lived alone in the home for more than 25 years prior to her death. I spoke with her almost daily, and visited her at least once a week. If she had noticed anything unusual and being of sound mind, she would have indicated her concern to me as she has done for more than 25 years. I would then check it out. Unfortunately, the incident occurred while the property was vacant for several months. It was obvious that Arbella, couldn't see the forest through the trees. He even had the audacity to compare it to a hot water heater failing. Well, I make it a habit that each year, I drain a gallon of hot water from the tank, to see whether or not, the water is rusty. This yearly test along with the water heaters age is a could indicator as to whether or not replace it. Their like robots in perfect harmony saying the say thing over and over again. It's the responsibility of the home owner, and there's nothing that they can or are willing to do. So I guess that I'm out the $1,400.00 for now anyway. Lets see what the AG's office has to say.
