Statement of Claim
Claimant says:
"On 11-6 hired Derek Carby with ashes away to clean chimney. Afterwards he said cap on roof was chipping off and needed to be fixed. There was some leaking in basement- we said ok fix problem. Total cost to be $262.00. He was supposed to re-mortar the cap and coat it with some sealant. I checked a couple of days later and he just did a wipe of paint on cap, contacted him and he came back out. He threw a small amount of mortar/cement on cap but still left some bricks exposed. He said he was coming back-never did. I went to Home Depot and got materials myself to finish the job because there is still small leak in basement around chimney area. It has been raining off and on for four days. Total cost of material and three hours of my time comes to $107.08. I would like the $107.08 back from ashes away."

  • I don't know if this company belongs to National Chimney Sweep Guild. The number is (317) 837-1500. You can call and find out. If in fact they do belong there is a NCSG code of Ethics Violation form and procedure that you can file a complaint. The website is www.ncsg.org. You can either print form out or request form be sent by org. There is no filing fee for homeowners. They have a committee that handles violation and there is legal action that can be done if in fact member is in violation. This maybe another solution if reimbursement letter is ignored.

  • In this situation, because you had a contract for a service to be performed, and the contract was not completed as discussed, you have the right to be places into a position as if the contract had been performed. The materials that you had to purchase yourself should be reimbursed to you. Here, you should write a letter indicating this complaint, and how much you spent in materials to finish the job yourself. Asking for reimbursement for your materials is a good solution in this situation.
