Statement of Claim
Claimant says:
"We went looking to by a used car or truck at the last week of july 2012. we went to a lot of places and ended up at bryant auto sales where my husband seen a couple of trucks he liked. we weren't for sure that was something (we) me and him would leave and talk about before making a decision. he had his heart set on this one paticular truck and its the one were wanting to file a complaint on. the salesman Chris Kyle, was the one who talked us into getting the truck we are now into and have 1 payment under our belt in a sense of speaking. he told us the truck had 1 owner and he would drive it back an forth occassionally to work and his ex-father in law was the owner before we got it from the car lot. he said the tires were new, no more than a year old. when really, they are 2004 tires and they are dry rotted from the insides, how we couldnt see that is beyond us cause my husband ran his hands across the tires to check them but they looked ok.so we test drove it and found the air conditioning wasn't working so before we were signing papers, their mechanics just added air to it to last for a little time till we were out the door with the truck. within 3 days we called them back about the air and they told us to bring it back they would take a look at it. so once again they just filled it with more freon and sent us on our way. again the truck lost air for a 3rd time and by this time we were getting tired of dealing with them, the salesman,Chris pushed a warranty on us and said it would benefit us if we had any probems with the truck, not us knowing what we were about to start experiencing. the warranty is 12000 miles or 12 months whichever comes first. so my husband was driving it back and forth to work which is like 18 miles one way monday thru friday, and it started making a lot of different noises and squealing, etc.then one morning he woke up to go to work and the back driver tire was flat not just flat like being able to patch it, but internally dry rotted and state code will not permit patching tires that old and it was unrepairable. we took it to tire kingdom and had them look at it, we had a spare to put on it, they put it on the lift rack and about...an hour later they found all...kinds of things wrong, so we got the estimate and went home and called the warranty department which is M.B.P.I. thats mechanical breakdown protection inc. also we called bryant auto sales to tell them all the 3,240.00 worth of damage they found and they replied our mechanics didnt know what they are talking about. we are now just dealing with DENNIS thru MBPI and they told us to take the truck back over to tire kingdom and drop it off till they send their adjuster to get all the problems down and yesterday (phil the manager) at tire kingdom called and said they came by but we are waiting to hear back from our warranty people now. we put 3500.00 down for that truck and the damage is almost what we put down for the downpayment. thank god the salesman pushed the warranty on us, we are a family of 5 and one working right now, i had surgery cause of ovarian cancer on july 18th and still trying to heal from that, and that car lot shouldnt even be able to sell cars if they are going to take advantage of ppl especially...now in this economy. I'm also taking forms to the dmv with complaint affidavits. and I want everyone to know just how crooked this company is. heres their address, BRYANT AUTO SALES 5130 S PINE AVE. OCALA,FLORIDA 34480 and number is 352-620-8200 and the purchase was made on august 2nd 2012. that's in marion county too. they also NEVER showed us a car fax report of a clean bill of sale, they have continually lied about the truck we dont really know how many owners there was and if they just fixed it up to sell then say it is as is which i know about that too as they didn't check that as is on our paper work it says sold with warranty. we are down to the one vehicle thats paid off till we get the dodge fixed. the truck is a 2002 dodge ram pick-up 1500 series quad cab and had 77055 miles on it when purchased (if those are the real mileage). we even called the financial place to let them know everything, and they were real nice but when we got it and about 3 days after having it they call and make sure the person is happy, well other than the air conditioner we were, cause we were unaware of the problems we were about to face. so, to end this on (i guess a positive note) we have a warranty but, if we have to buy tires out of our own pocket i dont know how we will do that? ) thank you, sincerely, Lisa Saul 352-751-4770 and our e-mail is grneyedblonde@centurylink.net"
