Claimant's opinion: I am writing to express my deepest concerns and frustrations that an extremely limited set of options were chosen and “dictated” as the only options for Group Supervision in my CES Practicum Course CES8780. The times given were Thursdays at 12:00 CST and 1:10 CST. I shared with my instructor, Dr. Cooper, that these times were in the middle of my workday and that there was no way I could consistently commit to either time. I stated that I have the following conflicts: 1) a standing 12:30 pm EST meeting every other Thursday; 2) there are from time-to-time planned client programming that can be scheduled on a Thursday that would tie me up from 11:30 am EST to 1:00 pm EST. I have no control over whether these happen or even if they might happen. Her response was the following and I quote: “I have placed the times for this course around lunchtime so that you could use your lunch hour to attend the group. I am hopeful you have worked out the schedule. Please let me know which one you would like to attend.”Dr. Cooper Additionally, I must share that I have been a Capella University student since April 2014, having completed my master’s in clinical counseling in December 2017 and then I started the PhD program in Counselor Education and Supervision in January 2018. In my time with Capella, there have been several courses which have included both optional and required group meetings of the students in the course. Every instructor that I have had always provided at least 2-3 options and these options were never on the same day and always included evening time slots. Additionally, during my Practicum Course for my master’s degree in clinical counseling, there were a couple of options provided for the group supervision and this always included an evening time slot. This is the first time that I have ever seen a limited option of group meetings for students. And I find that to only offer 2 options on the same day 1 hour apart is extremely exclusive and very unrealistic.

At this time, Capella University has also failed me by not adhering to another one of their policies. They failed to send my grievance to the Grievance Review Panel per Capella University Catalog and Policy 4.02.03.
Due to the failure to adhere to several Capella University policies, I am requested an immediate settlement before additionally legal action is taken.
I have very little time for Capella University, and a quick perusal of the other complaints posted here and elsewhere will tell you why. This for-profit, publicly-traded university seems to routinely mess up PhD candidates in a very big way. There are multiple complaints that I could whole-heartedly get behind.
This is not one of them. The claimant has not made a case for a million-dollar settlement, or any settlement at all, in my opinion. I can only hope that he followed the university's recommendation and either withdrew from the course until such time as he could negotiate the time off with his employer or a more convenient option was available. I realize that it is disappointing not to be able to complete a degree course in the timeframe expected, but I can't see that scheduling difficulties have anything at all to do with Disability or discrimination.
The only suggestion I can make in the claimant's favor is that Capella refund payment even if he did not withdraw in good time, as a good-faith gesture. It does, after all, cater to working people. I also agree with George Maxwell's comment that the claimant needs to explain further if we have all missed something.
I had a doctor fail me on an entire rotation because I had to fly out of state for an important job interview. Although I gave the doctor plenty of notice she was not prepared to change the schedule. The interview time could not be changed, so I went.
I did not file a million dollar lawsuit. I sucked it up and made up the rotation. I am rather shocked by this claim, and I am not shocked very often. I would have expected a candidate for a PhD in Counselor Education and Supervision to have a little more self-awareness and understanding of the practicalities of a course that includes other people.
I suggest that the candidate put off this internship until they can either be guaranteed an evening time slot or they can successfully navigate speaking to their employer about their schedule.
I have tried to read through this but there's a lot of material here. The whole claim seems to hinge on timing for the Practicum; the claimant would like it to be during the evening but it's only offered during lunchtime. Each session must accommodate 6 students for a 10-week course. The claimant is working, as are most Capella students.
Two things stand out to me: Capella says that the practicum is taking place at the claimant's place of employment, so therefore has the claimant asked their employer about giving an accommodation? I have to admit that it would seem highly unusual to me that their employer would NOT accommodate a schedule change in such a situation. So...have you asked? Additionally, what is an EST meeting--a work or school issue?
Secondly: what is the diversity here? Usually accommodations for diversity would include, say, extra time for exams to help someone with focus or writing problems, that kind of thing. Accommodation for diversity doesn't typically include schedule issues.
Given that the claimant is a counseling student, it might be of value to reflect on how they would help a client with the same difficulty to move forward. That would include boiling the problem down to its essence and finding practical solutions to consider, e.g. rearranging a schedule or deferring the course until such a time when their schedule can be more flexible.
I may well have missed something that would help me to understand the claimant's problem. If so, please let me know.
