Claimant says:
"I had an automobile accident on 9-19-16. They charged me $7800 for care.
My lawyer of course just paid the bill without questioning charges. I have
copies of all x-rays and images. The charge $4800 for three images on the cat scan. They took an x-ray of my chest and my Tibia. Each x-ray cost around $1100 each. The chest x-ray was in my opinion could not be read. The only thing that was hurting was my leg. I did not complain about my chest. I was not hurting anywhere but leg. I feel like I was over charged by the hospital. I was transported by ETMC but they were not running hot. They also are rated as a level 2 . They said that they based my trauma level because of how I arrived. I did leave with a bandage on my left elbow.
The Dr. got a piece glass in her finger. She left for a while but asked if I was in a car accident. I questioned the billing department but they said that
based upon the medical records that charges were correct. I feel like they overcharged me because they knew a insurance company would pay. This charge was taken out of my settlement. Any help would be appreciated"

    Ask for a full itemization of the bills and then go through them with a reputable medical billing advocate. Then negotiate with the hospital. Hospitals are known for padding and over-treatment; they will likely be anxious to either fully justify the charges or make a partial refund to you.

    It appears that this case has already been settled. You mentioned that the fees were deducted from your settlement. And if the Judge believed that the settlement was reached in fairness, I believe it will be very difficult for you to have the settlement agreement set aside, absent some compelling reason. Courts are reluctant to overturn a settlement agreement unless there was some factor. Settlement agreements are based upon the principles that the agreement was reached by both parties voluntarily. That the parties have a freedom to contract. Also, in most jurisdictions there is a time limit in which parties have to request that a settlement agreement be set aside. My resolution would be for you to go back to your attorney, or get the help from another civil attorney to speak with about your concerns.

    Radiation is not safe. Sometimes it’s justified to use radiation, but a good reason should be given to the claimant. WhT was the reason for 3 CT or X-rays?
