Statement of Claim
"i was called by Daniel O'brian ist part of july to advertise on radio. I said i would for the 2 wks but to send me what they were going to say. I didn't receive anything until the sat before it was to start 8-15 thru 8-25. I called right away to say the add was wrong and I only wanted 1 wk.and was told he didn't think so. Never received one new customer and called Danny back and he said to give it a couple more wks. Meanwhile a Senaka keeps calling from same office wanting me to pay. I call back to talk to Danny and was told he nolonger is with them.I don't own a radio I use ipod. I check my car and 98.9 does not come in or on friends boose. I called and left message with Senaka that I was calling BBB. He called back and said he would take one week off so now I owe 300 instead of 500 and that Danny was still with them. I really think the whole thing is a scam."

The claimant's settlement terms were rejected with the following explanation:
  • "My name is Robert Goldsmith, the corporate counsel that represents Clear Media. The mitigating factors and evidence in the claim are as follows: On 9/05/11 at 11:10 am cst, Ms. Hildum on a recorded telephone call agreed to purchase two weeks of air time on my clients broadcasting station in a verbal-non cancellable agreement. A media kit disclosing all of the facts of the air time, scheduled days to run, invoice, and hard copy of the broadcast announcement was sent to Ms. Hildum via certified mail. According to the U.S. Post Office this media kit was delivered to Ms. Hildum's address on 8/8/11. Ms. Hildum had numerous opportunities to cancel the air times and air dates, instead she called my client to edit the wording of the broadcast announcement. Ms. Hildum never complained about the station or air times until it was time to pay the invoice, typical buyer's remorse after the fact. As further evidence, my client has furnished a live MP3 of the announcements aired on the station and a legal affidavit of times aired. My client does not negotiate in these matters, these matters are either resolved at the invoiced amount or in court. "

  • I too was contacted by this company for "advertising" on a local radio station. The ad was to air from 10/31 - 11/25. After not hearing the ad for the first 2 weeks, I called the company to find out what was going on. I was told they would look into it and get back to me. Of course they never did. Today I contacted someone at the actual radio station who told me this was a scam. It is apparently happening all over the place. I called the company and spoke to Mike Johnson, Program Manager. He told me that the local stations don't know what kind of national advertising is going on with their stations. I find that hard to believe. I told him that I have filed a complaint with out local police department and will be filing in municipal court for the $400 we are out! Shameless people.     Feel free to call Mike Johnson at 866-483-5143. If they won't solve the problem, we can slam him with complaints!

  • I have been told by my radio salesrep that this a scam. After I was pitched on the phone I too recieved my packet. I called my salesrep and they immediatly filed a complaint with the AG of my state. They were asked to call the station mgr but never did. I talked to them and they finally cancelled my contract-at least vebally. I hope to get them to confirm that in writing
