Statement of Claim
Claimant says:
"The fact we could not go out or sleep safely without closing the windows on the first floor (Especially Summer time this will create big safety & security concerns), and the fact the bathtub plumbing is still blocked causing us lot of inconveniences for the past few months. The whole family have to use the only shower in my master bed room and causing us too much problems and inconveniences."

  • 09-20-2010 — Discover the windows issue - Need to close all windows they installed before going out or sleeping. This is a safety & security concern to us.
  • 09-24-2010 — Discover the bathtub plumbing blockage had not been fixed after spending #500 to unblock it.
  • 11-08-2010 — We called the company back in September about those issue but we were told Ben was on vacation until November. We called the company and Ben again in November to ask them to look into the issues but he was so rude & mean and tried to ignore the problems and did nothing about that.
  • 11-08-2010 — I called Ben again the second timne at night but again he was very rude and mean, and did not want to keep their promises to fix those issues. We are very disappointed and feel ripped off.
  • 11-20-2010 — We filed this complaint and claim against the Crystal Corp. for the unprofessional work performed by them and promises they did not keep.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "This is a simple miscommunication issue. First of all, Crystal Corp. had a contract with Mr. Wong to replace 3 windows, and the office never received any complaints from Mr. Wong after window job done. We offered him Crystal top line vinyl windows and proper installation. We believed that we've done very good quality job for him. If Mr. Wong found something wrong with those windows, he should contact us directly and we would send our installer to correct problem but not secure the windows, we can' t change the design for the windows. Also, nothing was shown in the contract regarding special secure on the new windows. They have to close windows when they come out. Secondly, Mr. Wong did not sign any contract related the plumbing job with Crystal Corp.. Ben stated that Mr. Wong told him that one of his bathroom shower faucet and drain pipe leaking , then he gave him a estimate paper described as follow: (1) replaced the leaking faucet for $250.00 ( included labor and material); (2)repair drain pipe leaking and install new bigger U pipe for better drainage $250.00 (included labor and material). Total $500.00 for this plumbing job. Mr. Wong agreed Ben to fix these two problems. Ben fixed them. While Ben fixed the drain pipe leaking, Mr. Wong asked Ben to solve a drainage problem too. Ben give a estimate for that job which will be a $500.00 additional charge. Mr. Wong did not want to pay for, but he asked Ben to perform a free service as a customer courtesy. Ben did it and he also inform Mr. Wong it will be a temporally solution. So we can't help Mr. Wong to permanently solve their bathroom drainage problem for free."
