Statement of Claim
Claimant says:
"I am an inventor client who was told if I paid $745.00 they could help me with my idea and then down the road after my idea was presented to a company then it would cost around $125.00 to get my idea patent. I was called each week with the same person Mr. Matlock
who said he was checking in with me to let me know where we were with the idea and if I had any changes in the idea. Each week the same thing from Sept. 19, 2011 to April 7, 2012 now this was seven months and no talk of anymore money. Until April he said they needed more money to make the chair and get it going I was shocked it was hard enough for someone with the economy to get the money I already gave him. He treated me like I was a stupid idiot. He wanted over $10,000.00. Now if he had mentioned this at the beginning of the idea I would have not even gave him the $745.00. To me this is an easy was to get peoples money take the $745.00 and don't even mention the other amount and just keep it how easy. I asked for my money back and they did not even say they would give it back. I sent them a email telling them I wanted my money back I have not seen where they did any work except what they have told me on the phone. I felt I was ripped off and if they were an honest company they would send my money back."

    In your post you state that you were not informed of the various services and related fees, and further allege that no work was performed under your contract. These statements are blatantly FALSE. A brief summary of events follows:

    On 09/13/2011, BEFORE your submitted your idea to us, you were provided with disclosures which explicitly detail the various services and their related fees. You acknowledged, via an electronic signature, that you received and read these disclosures.

    On 12/31/2011, you entered into a contract for pre-development services. These services were performed and the research portfolio was sent to you on 02/23/2012.

    On 03/12/2012, you completed, and SIGNED, a questionnaire in which you provided positive feedback about Davison, the product director handling your project, and the research portfolio.

    Despite having received our services, to your stated satisfaction, you posted this complaint. As detailed above, there is no basis to warrant a refund for services performed to your documented satisfaction.

  • All the information sent to me in the mail were packages explaining the steps the company took in the idea you have and you sign saying you want to proceed and pay the amount which I did. The company worker calls you weekly asking if you have anything to add this goes on for months. Then the next stage they send a CD which looks like the one you are told to view on the internet about the company and how they made other peoples ideas come true and they show the royalties they make sure you see that they show it with all the clients who had products made. It gets you thinking wow I could do this have my idea made. The phone calls keep coming and its the same questions and they send the videos to watch a few more times by email and I watch them and get excited this could be me. Then they tell you months down the road a package will come with another form to fill out and another step of what they have done. A package comes but, its basically the same videos of how your idea can come true I then feel hey what is going on its all the same stuff over and over but this time they show a product like yours but not mine its something similar to your idea and then you have forms to sign and they want to make a mark next to the royalties box and that is where the large amount comes in and well I did not sign this and did not send it back in the prepaid envelope because I did not have that kind of money. This is what goes on and I did receive a letter for the first amount $745.00 and signed it but the second one no way. I just felt something was wrong, I called the person I was dealing with and I asked what this amount was and he said it would determine the amount of royalties I would receive by the amount I put a mark next to to produce my product and send it back signed. I thought could this amount be right but he didn't say anything about this amount until now I was a bit upset. The smallest amount was over $10,000.00 and this amount was just now being presented to me and all this time had passed months and months, and if I only knew and why did I know this ahead of time "why."

    And when you said I entered a contract for pre-development services and these services where performed what was performed I saw nothing just what I heard over the phone and saw on a CD of some other idea, not mine and how the steps are taken and what I could have. Now if my idea was made it could be video taped and sent on the internet or one of their CD's like the others that were sent, but it never happened my idea never transformed for me to see. I completed and signed a questionnair on services and how I was treated but all was well at that time I was just waiting to hear about my idea. Well I was told how they were doing on my idea I believed him that my idea was coming right along and doing great So I do not know if my idea was ever made at all.....I should have evidence shouldn't I?
    I know what was done step by step and I have the CDs the information on a similar idea but not mine, and a envelope of all that was sent and copies of the letters I sent and ideas it is all in my file so don't tell me what was presented to me. The first folder is quite innocent you pay a certain amount and your idea will get started and your worker keeps in contact with the client and this is months down the road and then the next package and contract is a different contract a sample agreement and amount that was never mentioned I was aware of the patent fee and I thought that was all I had to pay next, then this came up, so don't tell me what was presented to me.

    I feel the people that are representing your company need to be upfront on the amounts they are quoting the inventors so they know up front all the fees that they will have to pay. No I haven't seen with my eyes any kind of product from my idea or what was made from the fee I paid not one thing shown to me, which could have been show on a video if there was one. I sent my drawings and information to your company and how I wanted my idea made all the information was produced by me and faxed to your company. I feel there was no information or ideas from your side on how my money was used and how much more I was to come forward with. I would have never proceeded with this company if I knew how much more it would cost. I can see that you have many other people who filed complaints possibly they had the same experience as I did. Yes, you may be a fine company for people who have money to spend but, I don't and I just threw away $745.00. It makes me feel bad and yet you do not want to step up and make it right. If I had allot of money I would say oh well small loss but, I am like everyone out there who is having a hard time. Word of advice Be forward with your customers and let them know all the amounts they need to pay don't wait till they have paid the $745.00 and then say well there is another amount you will have to pay surprise! I am sure this is why you have suits against you. Thank you for your time you are a nice company but, you go about it the wrong way not being forward this seems sneaky to me. My husband thought is sounded like a scam. I didn't think they were dishonest but now I have second thoughts for sure. This is why I am complaining Thank you.

    I read what you said against me and I am telling you the truth and my husband backs me up I have showed him everything I have followed through with the Davison co. I even asked the gentalman who was handling my idea if there was anymore costs and he did not mention the large amount even though you seem to think so.
    I can repeat until I am blue int he face that the thousands of dollars were not discussed until the folder came in the mail and I called and talked to the person who was handling my idea. I feel sick that we have lost the $745.00 and that I never did see any work done by Davison just someone calling me weekly asking the same questions all the time. That was then I felt what is up with this company I haven't seen their drawings or ideas on making my idea come true. They sent videos CDs in the mail of what there company did for other people and packaging ideas for the products they made. I then felt maybe I should check with BBB Better Business Bureau and it showed this company has 242 complaints against them "well now they have mine too".
    If they are such a big company how hard can it be to reimburse the amount that I gave to them?
    I don't want to write anymore it makes me upset to think how I was led on for months and never knew about this large amount till that last folder came in which I was glad I didn't sign it and send it back.
