Statement of Claim
Claimant says:
"I contacted George about a Mercedes I had. I have fallen on hard times and needed cash to buy myself a new car while his brother Manny was in my home he noticed my Tiffany lamp and made an offer on that as well. I really didn’t want to sell either of these things especially the lamp. But I did. Immediately upon selling lamp I had regrets and my son was very upset with me because this was a piece of his family‘s history and they are all deceased. I Contacted Manny the very next morning told him I had a change of heart and could he please return the lamp to me. And I will return his check. His answer to me was “you sold it I have no obligation to return it to you.” Even after I told him of the sentimental value of the lamp. I’ve made numerous attempts and have pleaded with him to return the lamp to me but he will not. Every time I contact him he has different reason for why he can’t return the lamp to me. I even offered him more money for the lamp than what he paid me. He refused. This got me to thinking that perhaps the lamp was worth more than what the $2500 was that he paid me for as I have photos and markings of all the lamps I own I subsequently sent this to a online appraiser the online appraisal came back as approximately being worth six to $8000. When I brought this up to him and that his price was unfair and he took advantage of my ignorance. His respond also was a deal is a deal you should’ve done your research before hand! I feel as a person in the business of buying and selling collectibles is unfair and this honorable. I’m hoping someone can help me recover my lamp or at the very least be provided with a more fair price."

  • You cannot make a deal with someone, accept the deal and money and then try to get more money after the deal has been completed. It just doesn’t work that way. Also, the lamp has nothing to do with my business. We sell antique cars. Not lamps. This is irrelevant so please take this down or we will be taking legal action against people claim and we have already started to do so against Karen Goodman who is slandering us because she has sellers remorse over a lamp. Very inappropriate and not business related.

"A company's legal obligations and ethical obligations are two different things. Dragone Classic Motor Car's legal obligations are going to hinge on what type of licensing it has in Connecticut, and whether that type of licensing is going to make a difference to its obligations to this claimant as a customer, particularly when a representative of the business visits someone in their home and makes an offer on something not originally offered. You will need to consult a lawyer licensed to practice in Connecticut about this.

Ethical obligations are a completely separate issue. If someone is in dire financial straits and therefore vulnerable to an offer they might not normally have considered, and then repents almost immediately, what would be the right thing for the company to do?"
