Statement of Claim
Claimant says:
"In early 2014 I bought a vintage Bulova Accutron Spaceview watch from Eric Grafton trading as Quality Time on his website accutronspaceview.com. The watch arrived in the UK and all was fine.
Later in 2014 I asked Eric of he was prepared to resell this watch for me as I might prefer a larger size watch; (in that era the average watch was smaller than contemporary watches.) He agreed to resell it and I posted it back to him. It arrived safely and he sold it shortly after that.
After a while I asked him to return the balance after his 30% commission deduction which he said he would do. Initially, he was quite helpful but the vindictive change came when he realised that I would not buy another watch from him. After a couple of weeks I hadn’t heard or received any payment so I emailed him. He replied telling me that I had been ‘indecisive’ and because of that he wasn’t inclined to pay me the balance of 70% anytime soon. That was in February this year!
I pointed out to him that he had not lost any money in the 2 sales as he had the full price for the original sale in early 2014 and the 30% (quite large) commission for the 2nd sale and in any case, we had no written contract; it was simply a commission sale for which he has been paid. I was simply thinking of perhaps buying a different model but at no time did I commit or agree or guarantee him that I would actually do so or give him the sale. However, as he had given me his word as an internet seller/restorer, I wasn’t unduly worried as he had promised to pay me after his next sale.
Since February, I checked his site regularly & noticed recently that the only watch for sale on his site had been removed and another Spaceview was listed for sale. He has 16 items listed but only one is unsold.
I mailed him a couple of times but he did not respond. I telephoned the number shown on his site but received a message that the number is out of service.
My emails to him have not been rejected so I assume he must have received them. To date, I have not been contacted by him as at Friday 26th June 2015.
Since looking into this, I have discovered that Mr Grafton doesn’t have a good reputation for customer service. There are several disputes recorded for example on BBB.org. Unfortunately, as I live in the UK, litigation is not possible because of the cost. I did contact a solicitor in New Jersey but it would cost $400 just to send him a letter.
The amount owed to me is $682.50 as the watch sold for $975 less his 30% commission. This is about 455 GBP, a substantial amount to a retired person. I cannot call this anything other than theft I’m afraid as he has deliberately withheld the balance that is due to me after receiving his commission.

  • Eric, I mailed you for an update but no reply as yet. Could you please tell me if you intend to do the right thing here and repay the balance left after deducting the 30% commission as you "promised??";Your telephone number is not in service it seems. I notice that the cushion case is no longer on your site so presumably has been sold as there is another spaceview for sale. You did promise to pay when you got another sale if you "recall";However, I haven’t received the outstanding amount or even a part payment despite promising to honour the debt. For example, if you had paid just $100 say, per month since February, it would be nearly paid "in full.";Your site talks about your skills and “the level of expertise, care and professionalism or knowledge” you provide and that’s true regarding your watches but customer service is also important and surely professionalism also includes treating your customers with respect and honouring promises?
    And especially as in my case, you haven’t actually lost any money as regards the original sale and the 2nd sale on commission. We’ve all got to make a living and have bills to pay so I urge you to pay the amount outstanding via Paypal and honour your promise.(Above is the last email I sent him; to date, I've had no response.)
