Statement of Claim
Claimant says:
"My house was foreclosed May 5th 2011 and the new owner was Fannie Mae .

May 9th late evening , REO representative under The Giving Tree Realty said I need to vacate the property and giving relocation assistance for house keys .

I was upset since I tried loan modication to short sale but Bank of America declined.
I went to The Giving Tree Realty in Chatsworth May 13th to discuss the options , she mentioned the terms of movement like May 23 $ 4000, June 8th $3053 and June 23 2050.

We are not ready but i tried to negotiate to maximum $4000 plus June 23rd , she open up that we make an agreement today and sign document so she can negotiate or help me but later decline . We struggle looking for a temp place till a good samaritan help us . We started moving in to the new place May 26 . June 1 late evening while we are going back and forth a legal messenger came and handover a Quitclaim notice . I told the guy to tell his boss we are physically moving out and an agreement were signed . Its unnecessary but he said just a messenger . All services were cancelled on or before June 2 so there is no way to live there.

June 3rd we met REO The Giving Tree and mentioning some stuff in front of the house . I told her those are for yard sale . She refuse to give the check so I told her I will give it away just to satisfy you.
The next day all are gone for free and even went back Sunday evening to take out the trash bins for Monday pick up . June 8 or 9th we met again late afternoon at the house but she is mentioning a new agreement to be sign and check deduction . She even harrassing that if I dont make a deal today , the Unlawful detainer will proceed .

I said no , by signing the first agreement was depressing . I reiterate to her that you mentioned you will help me now what . I also mentioned to her that the remodel kitchen cabinet are not fully paid , I will just get it from the offered relocation money. She even open why i took the gas range , i ask her did you mentioned specific things and instead I left my diswasher there . Our discussion is not getting anywhere so I left with all the house keys with her.

I tried to talk to Fannie MAE so many times back and forth even ask me to call the ATlas REO 18582595758 xxx2215 but do not response from any of my voice messages.

For the past month I call every week Fannie MAE but always getting transfer to Level 2.

March 7 at last Level2 responded but instead of helping his response is more depressing Lloyd ID#A360F 12noon said that they wont pay any dime .

Hopefully you can assist me getting the overdue relocation assisstance.

  • Do you have a home or do you own a home ? What will you do if you are in my shoes.? There was no physical check presented but forcing me to redo the agreement and sign a new document plus accepting a reduce amount .
    Do you think if Trisha Martin - REO The Giving Tree Realty handover the check to me . Will I return it her ? What do you think ? Of course I will take the check and go after the balance . BUT PLAIN NOTHING . I dont even know what your check look like .How could you sleep at night ?
    What transpire that day was I need to sign a new document again and when I ask the check she said , document first before processing the check .
    I am only asking what is due to me no more no less? I have been calling your customer service for the past months but you are just diverting to so many people . The house and things were intact , you sold the house in six months when other houses within the vicinity were posted more than 1 year and still not yet sold ? Why ? How can you say breach of contract ? What was your intention when you filed an Unlawful detainer ? Isn't it harrassment ?
    Would it be better that people handshake and move forward ?

  • Unlawful detainer filed by Fannie Mae dated June 8 ,2011 when Physically the house is vacated June 3, 2011 . They filed in Los Angeles Superior court Vannuys case# 11B03285 .

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Ramil Miranda did not meet the terms of the Relocation Assistance Agreement. Per the terms of the agreement, occupant is to leave the property in broom-swept condition with no personal property in or on the premises. On the agreed-upon date, an inspection was performed and the property was not free of personal property. Ramil Miranda agreed to remove the personals and stated that he would do so in a few days. Fannie Mae adjusted the amount of relocation assistance to $2800 due to the terms not being met on the agreed-upon date and for the extension provided to meet the terms. On the following inspection, personal property was still found in the rear yard and garage of the property, which again, disqualified him from receiving the relocation assistance. Because occupant showed due diligence and because the amount of personal property left was not excessive, the lower amount of $2800 was still offered, but Ramil Miranda refused to accept the adjusted amount. After weeks of holding the funds for disbursement occupant showed no interest in receiving any amount of relocation assistance. Thus, it was finally determined that the occupant was found ineligible to receive the relocation assistance due to breach of contract and refusal to accept reduced amount. "
