Statement of Claim
Claimant says:
"OUR NATURAL BAMBOO WAS PURCHASED IN 2012 AND WE STARTED HAVING PROBLEMS WITH IT SEPARATING IN EARLY 2013. (IT IS A FLOATING UNICLIC FLOOR) BY MOHAWK. WE REPORTED IT TO FLOORING UNITED, FORT MILL, SC, WHERE OUR SALESPERSON (SIGNATURE FLOORING & DESIGN, WHO WAS A CO-OP OF FLOORING UNITED) GOT IT FROM, ALONG WITH A KITCHEN TILE FROM THEM AS WELL, EARTHWERKS. BOTH THE FLOORING AND THE TILE HAVE LIFTED AND SEPARATED. ON NUMEROUS OCCASIONS, I HAVE TALKED WITH THE OWNER OF FLOORING UNITED, DALE WARD, AND REPORTED THE PROBLEMS TO HIM. I HAVE ALSO BEEN IN CONTACT WITH MOHAWK FLOORING, OUT OF DALTON, GA. WE HAVE HAD INDEPENDENT INSPECTORS COME AND FILE REPORTS WITH MOHAWK, WHO THEN IN TURN SEND THEM TO FLOORING UNITED, WITH NO RESULTS ON THEIR PART. AT ONE POINT EARLY 2014, FLOORING UNITED SENT THEIR ORIGINAL INSTALLER TO MAKE A REPAIR ON BAMBOO FLOORING AND HE DECIDED TO PUT IN TWO THRESHOLDS, BOTH OF WHICH ARE HIGHLY VISIBLE AND OF VERY POOR GRADE OF "SCRAP" LUMBER. THEY DO NOT MATCH THE BAMBOO AND ARE ROUGH WOOD. WE STILL HAVE 2 BOXES OF THE BAMBOO FLOORING LEFT FROM THE ORIGINAL JOB. THE KITCHEN TILE IS LIFING AND CAUSING US TO TRIP ON IT (WE ALSO HAVE LEFT OVER TILE FROM THE KITCHEN AND BATHROOM INSTALLATIONS) AND IS VERY UNSIGHTLY AS IS THE BAMBOO FLOOR "REPAIR". WE ARE AT A STALEMATE SITUATION AT THIS POINT WITH NO RESPONSE ON THE PART OF DALE WARD OF FLOORING UNITED, FORT MILL, SC.
THE SITUATION SEEMS TO BE IN HIS HANDS NOW AND HE IS DOING NOTHING ABOUT OUR FLOORS, WHICH WERE AN EXPENSIVE ENDEAVOR FOR US, SINCE WE ARE BOTH RETIRED."

  • I WOULD STILL LIKE TO HAVE DALE WARD OF UNITED FLOORING TO INSPECT BOTH THE GREAT ROOM (WHERE THE TRANSITIONS ARE) AND THE KITCHEN WHERE THE TILE IS LIFTING. I WILL SET UP ANOTHER APPOINTMENT WITH HIM.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "I have sold and installed this Bamboo floor by Mohawk seven times. The first job I installed has had no problem, the other 6 have all had problems. This floor was very popular at first. Each of these 6 floors have been reinstalled twice by my company. The first time we tried not to use the transitions but when this failed the second time we did as Mohawk instructed and put in transitions. No one likes theses but they are necessary with this product. The first floor(that has no Problems) was in installed with no transitions and was over the dimension limit that Mohawk later set once the problems began. Mohawk changed the acclimation time printed on the box from 72 hours to 7 days. I found this out when I ordered some extra bamboo to do a repair on one of the jobs. This makes me believe something changed in the production that is the cause of the problem. All of these jobs were install for one year or more before the problems began. I installed it in my own house on 5-5-2011. Our 3rd job of this floor and we done the whole house with no transitions, 2000 sf. I did not have a problem until the summer of 2013. Now I also have a few gaps up stairs but none downstairs. They seem to close in the winter and open in the summer. Still unfixed.
    I have repair Miss Singletons Bamboo floor twice. The second time we did put in the transitions and this seemed to fix the problem until I heard again from her that she had a problem. I called Mohawk to send out another inspection and they did and I received their report last week and they found nothing wrong with the floor except the transitions did not match as well as they could, which I will be happy to replace. Her kitchen floor is a new problem that I have reported to Earthwerks and they asked me for photos. I was scheduled to go to her home today at 2:00 but she called yesterday and postponed that meeting due to an illness. I have every attention to help her with her flooring problems.
