Statement of Claim
Claimant says:
"Mr. Galloway has not handled my income tax services for my mother in a professional way. First he charged me $55.00 for my deceased mother's tax return. When I gave him the check he said he thought I was the only beneficiary so he filed as an individual tax claim. He showed me paperwork stating what would be refunded to me and said he had misunderstood and made a mistake. He then told me it would be an estate income tax return and charged me another $100.00. He has held the paperwork for some time and made himself very unavailable to me until he requested the additional money. He also asked for my sister's social security number which I have no right to give him even if I had it. I went to the IRS and was told that my mother didn't generate enough income before her death in August 2013 to have to file. I also received information that if the estate isn't generating money or making any profits; it is possible that it is unnecessary to file an estate income tax at this time. Mr. Galloway is never available in person and I can reach him only through leaving messages on his answering machine. He requested additional paperwork that he claimed he needed including my sister's SS# and asked me to put it under his door. I made an attempt to do so and it wouldn't fit so I called him and got his answering machine again. Now he has sent me a letter only because I told him I wasn't satisfied with his services, that he was very unprofessional, and I asked that my paperwork to be returned to me. His letter dated 09/17/14 states that I did not give him paperwork that he needs therefore if he doesn't hear from me by mail within 5 days he will file the papers that he has without them. I was warned by several people about his unprofessional tactics but I foolishly decided to find out for myself. I want my money and paperwork back. Mr. Galloway is involved in many other enterprises and when I approached him about the untimeliness of his services I was told that he works from out of his apartment and doesn't have anyone to assist him. He has time to send out emails about social events etc. I told him in the beginning that I only do business face to face and not through message machines, emails, or the mail. I live in the building next to his so there is no reasonable excuse for me having to chase him down especially if I am paying for his services. I am concerned because he has in his possession copies of my mother's financial records etc. I left him another message tonight 9/18/14, asking him again to return my paperwork. Please help me resolve this matter as soon as possible."
