Statement of Claim
Claimant says:
"i AM UNHAPPY BECAUDE HI-TEK AUTO PROTECTON has taken advantage of me.  They have not refunded me my deposit of $290.00.





 
Dear Customer Service Person;
I am hoping you can he help me with getting my $290.00 back from HiTec Auto Protection.  Approximately on August 11,2016. I made a down payment in good faith to purchase protection for my Prius, Toyota 2013.  I charged the $290.00 to GECU Mastercard.  I was pressured to make the down payment pending I checked what protection I still had with the local Toyota dealership.  
Well, I found out my car is still protected till 2018.  The representative of HiTec, Robert Jagan, assured me I would be able to cancel this transaction and get the $290.00 back,
I followed the merchant's service contract refund policy(see attachment).  I sent a letter of cancellation dated August 19, 2016 via email and a letter via US postal service mail as well within the 21 business days as stated in the refund policy--and I waited for the refund and I am still waiting.
I started calling the merchant at 188-510-1943 starting approximately in November, 2016. In December, 2016 I was informed that a check would be sent out to me on 12/23/2016.  A check was being sent to me instead of crediting the Mastercard because GECU issued a new chip credit card number. The merchant's receptionist decided cutting me a check would be appropriate in this instance.
I continued calling every month since then.  this is log of the of my following up this this merchant. When I call Kimberly is the person I have talked to all these times:
Jan 2017-Kimberly-the check will be sent out at end of month
Jan 31, 2017-Kimberly-again was told the checks go out at end of month and  was to have the supervisor call me-
Feb 4, 2017- held the line for 5 minutes and was hung up on
Feb 5, 2017-held for 5 min and again was hung up on
Feb 7, 2017-Kimberly tells me the checks are cut and sent out to customers at end of month only-said all she could do was to leave a note for the supervisor, Jason Garcia,call me-as a second request- have not yet heard from any supervisor.
Feb 8, 2017-Kimberly again and again didn't know why the refund was not processed but would send a 3rd request to supervisor, Mr. Garcia, to call me
Feb 13, 2017-Kimberly again and again said checks were sent out at end of month-she would not offer any other information
Feb 24, 2017-Kimberly stated positively that the check would be mailed out Feb. 28, 2017
March 4, 2017-no answer
March 7, 2017-Kimberly says the systems were down and could not check on anything, to all back tomorrow in the AM
March 9, 2017-no answer
March 14, 2017-Kimberly says the system was still down and trying to fix it-so to call back
March 15, 2017-no answer
March 16, 2017-Kimberly states that she only work there, didn't know why check was not sent and would request the supervisor, Mr. Garcia, call me-Said to tell him that I was to take legal action
March 27, 2017-Kimberly says the system is down and could not give me any information
March 24, 2017-no answer
