Statement of Claim
Claimant says:
"I am filing this complaint against the home depot head manager by the first name of Blayne and another manager by the name of Vennesa. On Friday morning, November 2, 2018 I went to return five new items that I no longer needed and for which I could not find my receipts. The young man at the return desk refused to give me my money for the amount of the five items: a ryoby buffer, a tube of ceramic tile caulk, two dremel attachments and a quart of premixed adhesive/grout. I asked the young man at the return desk if I could see the manager, so he called Venessa, who refused to return my money or give me a home depot store credit card.

The week before I had shopped a lot at that store and I lost my driver's license there and had to get a temporary driving license from MVD, however Venessa refused to acknowledge my temporary driving license despite the fact that it has my picture and my driver license number. She told me that it was store policy not to accept a temporary driver license. I then asked her if there was someone else above her and she mentioned Blayne. At that moment another male customer walked in with about 10 items on a large cart. I stayed to watch how he would be treated, and Venessa approved the return of those items despite the fact that he did not have a receipt either. I asked Venessa how come she approved the return of that man's items without a receipt either. I then told Venessa that I was going to file a complaint with the better business bureau, and she then decided to give me a home depot store credit for the ryobi buffer for the amount of $26.94. Card # 6417. I asked Venessa why she didn't give me store credit for the remaining four items, and she told me it was store policy not to approve more than one item returned, so i told her she was being very inconsistent. I took my remaining four items to my truck, and went back in the store and bought a tile cutter with the store credit card for $26.94. On the way out with my tile cutter, I asked another store employee if I could see Blayne and the store employee pointed out Blayne to me, so I went to see Blayne who at first was very polite and courteous.

I explained to Blayne what had transpired with Venessa and the young man at the return counter. Blayne then told me to go get my other four items from my truck so he could help me so I did so. Blayne then put the four items on the contractors's check out register counter, but by then he had changed his attitude and spoke to me in a very demeaning behavior. When I interjected what he was going to do to help me, he told me to stop interrupting him. Then he got the four items and my temporary driver license and stood behind a computer for about ten seconds and told me the computer did not approve anything. I told him that was impossible and that he actually did not do anything on the computer. I told him I could call an Albuquerque City Police to confirm and verify that my temporary driving license was valid. And he said the police were not welcome in his store. So, I told him I didn't understand because i am a regular customer and saw the city police cars there quite often. Then he said that was because he invited them. I then I pointed to two cash register females who were checking out other customers and told him they knew me. He asked me their names so I said: MaryEllen and Jennifer because I'm at home depot very often, especially lately because i was remodeling a kitchen. He then said "well let's go talk to MaryEllen and see if she knows how to help me, Blayne, on the computer."

When we got close to MaryEllen's cash register he was about three feet behind me and was starting to walk away, so I told him he was the one who wanted to talk to MaryEllen, who greeted me very friendly because she has known me as a regular home deport store customer for many years. MaryEllen told Blayne that she's known me for many yrs. She appeared confused as to why Blayne and I were there. I told MaryEllen that Blayne wanted to know if she could help him use the computer to get my items returned, and she said she didn't know how and apologized to me numerous times. I started to leave and Blayne told me to have a nice day, and I said: "how can I have a nice day if you already ruined?" under my breath.

In the mean time I went to a police substation near my home and told a police officer what had happened at home depot regarding my temporary driver's license. He looked at my driving license and told me the two managers at home depot should have approve them. This uncomfortable experience had never happened to me at this home depot.

I hope Blayne and Venessa aren't treating other customers the way I've been treated. I also do not want them to retaliate against me and if something happens to me they are to be held responsible. I am a disabled 72 year old man suffering from muscular dystrophy and spinal stenosis. What transpired with me constitutes elderly abuse inflicted on me by these two managers."
