Statement of Claim
Claimant says:
"On May 25, my airconditioning units failed to work properly. I have a contract with Total Protect which covers all the appliances including air and heating system. However, a service representative was sent out and he discovered that the unit needed the coil replaced. However after weeks of being given the run around, we found out that the coil could not be replaced because of being outdated, The company kept reassuring us that the service representative had located the new coil. The service representative recommended that the company replace the air and furnace in order to solve the problem.
However the company informed us that they would only pay for the cost of the coil ($675.00). According to the contract, we were under the assumption if the appliance could not be fixed, it would be replaced. THE new units would cost total $4300.00. The company informed us that the replacement cost would be our total responsibility and they would only send us $675.00 when we send them a copy of our reciept after the replacement.

  • From researching this issue, it seems that Homesure of America is an insurance company that offers an appliance coverage plan called Total Protect, which covers both repair work on existing appliances, if available, and a discount plan on new appliances. If the parts are available, the insurance will cover repair of existing appliances, however, if parts are not available, it will offer discounts on upgrading the appliances. Here, it seems that while the insurance company was attempting to obtain a part for an existing appliance, it was unable to. Therefore, it offered a replacement at a discount (discounting what the cost of the coil would have been). It does not appear that total replacement is an offer under this particular insurance, and what was offered is in terms with what is normally offered for replacement appliances.
