Claimant says:
"A eye dotor at the florida eye clinic told me it was not my perscription and dont wear them ."

The claimant's settlement terms were rejected with the following explanation:

    "Mrs. Janet Timbrell was seen on July 21, 2010 for her eye exam and glasses, she decided to use her own frame and was told that since she could not leave her frame to be sent out to the Optical Lab she would have to go to our Kissimmee office to have her lenses cut and edged.

    The lenses where delivered on Monday July 26, 2010 and she was notified and was asked to come to the Kissimmee office to have them cut and edged. It was July 28th, 2010 when she came in and glasses where done and fitted to her face and dispensed to her. No complaints up to this point.

    We did not hear from her until November 30th 2010 when she came in claiming that she could not see clear with her glasses. Our Dr. Mazlin offered a free eye exam even tough she could have been charged for it since four (4) months had gone by. Also Dr. Mazlin told her about a mild cataract present that she needed to have it checked by an ophthalmologist.

    A remake minimal fee was requested which would have only covered 50% of the Laboratory Charges for a new set of lenses since the dateline for a redo is only thirty (30) days and her lenses where past that dateline.

    Then on December 8th, 2010 she came into our Saint Cloud office with a violent attitude and using profanity, demanding she be refunded her "F" money that the "F" doctor gave her the wrong prescription. She kept on cursing out loud to our staff and disturbing the peace and was asked to leave or the police would have to be called.

    There are no grounds for her claim since:

    1) She did not come back in a timely manner
    2) Options were offered to her for new lenses which she declined
    3) she verbally abused our staff

    We reserve the right for not allowing her to come back to this office
    "
