Statement of Claim
Claimant says:
"On Jan. 27, 2018, approximately 1900 hrs (7pm) Deputy Mastantuano of the Lakewood, California Sheriff's Department harasses a 57 year old innocent woman, leaving her traumatize. First he accuses her of trying to hit his Police Car, which doesn't make sense when she drives a Mercedes with very low miles? Then he accuses her of stealing from JCP, when she didn't even go to JCP and wasn't parked near JCP. She tells him she is a diabetic and is having a low sugar to call the paramedics and he refuses, instead he says drive to the Lakewood Sheriff Station? Isn't he aware she could get into a car accident if she has a low sugar! I did not drive my car home, my daughter had to go to the mall and drive my car home. When he returns her Driver's license he doesn't hand it back instead he waves her driver's license up and down. This all happened during the evening, and yet he ask her what color are his pants? Why would a Sheriff Deputy act in this unprofessional manner, and continuously yell at her? There were witnesses who came to the 57 year old woman's defense."

    This seems like a possible case, but has the Sheriff's Dept begun investigating since you filed this claim? If so, you should proceed further if necessary only when their own investigation is complete. Some Sheriff's offices can be very good at properly disciplining officers who make mistakes.

    There are two issues: 1) Accusation of theft - officer needs to justify why he thought she had stolen anything from JCP. Was she charged, and if so, what happened with that? 2) Low blood sugar. I thought it was routine for officers to be trained to spot this as it is not uncommon and it's highly dangerous. Can definitely cause car accidents. If this training is not in place, it should be put into place immediately. It is hard to tell whether any damages are owed until all facts are known, but I suspect that what the claimant really wants is a very sincere apology for humiliating her.
