Statement of Claim
Claimant says:
"On May 26, 2013 I bought a membership for Margarita McMillan (wife) in the Las Vegas Athletic Club (LVAC)and used my credit card to make $22 automatic monthly payments.

In May 2013 her Neurologist MD advised that Margarita would not benefit from therapy at LVAC. In June 2013 I requested that LVAC terminate that contract. They responded stating that a medical written statement was needed to terminate the contract.

Due to declining health of Margarita and incurring severe out of pocket medical expenses reaching thousands $ per month I forgot about LVAC and continued auto-payments until my credit card became compromised in December 2014.

LVAC has attempted to collect more monthly payments from me since Dec 2014, but I refuse to pay because no service was ever provided to my wife.
Margarita McMillan has never opened a door to enter LVAC premises since May 2013. She has become permanently disabled and requires 24/7 daily care

In March 2015 I obtained the medical statement LVAC wanted, showing dates of care commencing in May 2013 at Cleveland Clinic, and forwarded the same information to LVAC. I requested that I be reimbursed for nineteen $22 payments ($418) made from May 2013 through Dec 2014.

They stated they would be willing to drop the charges from Dec 2014 to contract termination. I refused to accept that proposal. I want reimbursement for all payments made from May 2013 to Dec 2014.

They made a pure profit from me, to date of $418, and they want $237 more because I refuse to pay more. I want my money back

Now they have turned my wife's account to Quantum Collections and the total is now $237.

In March 2015 I provided information required by the contract. To date they have not reimbursed me for my payments.

I have an excellent credit rating.

At this time LVAC and Quantum Collections are attempting to coerce me, to pay even more for services that were never provided by threatening to downgrade my credit rating.

I breached the contract, but the contract is predatory, and I didn't realize it until now. Go to consumer affairs.com to see just how predatory LVAC is.
