Dear Mr. Kim, We are sorry to hear about Lucky Pioneer’s experience and we do not condone deceptive sales practices but we do not have access to Pepco badges. While we did try to prevent Lucky Pioneer from incurring the Early Termination Fee, they insisted on Liberty Power setting their account to de-enroll on Dec 14, 2011 and again on January 10, 2012. Due to the fact that time period to rescind the agreement passed we must uphold the Early Termination Agreement. The contract was signed on November 8, 2011 and Mr. Kim did not call to cancel until December 14, 2011. Again, we do extend our apologies and we will be speaking with this external salesperson. I called you the day I received your welcome letter. now your claim of the time period is so absurd when you send your letter more than a month later. When I received a letter from Pepco informing the change, I called Pepco to let them know that I did not make a change to my power supplier. And I thought everything was taken care of then. I did not have Liberty power's contact number until I received the welcome letter.
Dear Mr. Kim, The agreement was terminated on December 30, 2011 when we received information that you went with another supplier. According to our records you signed the contract on November 8,2011 and should have received a copy of that contract along with the Terms and Conditions. Located in the top right hand corner is our contact information in case you wanted to reach Liberty Power. A welcome letter was sent on November 21, 2011 and not a month later. In the section right above where your signature appears on the contract it is boldly printed that you have three business days to terminate the agreement without receiving the Early Termination Fee. Again we do apologize for your experience with our sales person but at this time we must uphold the Early Termination Fee. Regards, Oye
I had not received copy of contract nor informed that it was a contract that I am signing. The rep. for liberty power never identified herself as a sales person for liberty power. Only thing she said was that she came to fix billing problems with Pepco. If she mentioned the contract ,I would've never signed it because I am under contract with another company already. I believe that I received the letter around Thanksgiving. I called Liberty Power the day I received the letter to explain the situation. My understanding from that day was that everything was resolved. Then Liberty Power came back with letter of early termination with unbelievable fees. It seems to me their goal is just to get someone sign the paper in any way they can make up the story and muscle their way through to rip off public. And like I said before I offered to take them as power supplier when my contract with current supplier end in April, they told me to pay the early termination fee to my supplier and take the Liberty Power as my supplier. Why should I pay for something that I should not be bothered with. It is just like the Liberty Power hold a gun on my head and demand a ransom. It was never mentioned to me that they were at my store to sign me up as their client. They denied it when I asked them if they were here to sign me up. They told me the only reason they were at my store was to fix billing problem with Pepco.
Dear Mr. Kim, Liberty Power cannot hold your contract until April and we do apologize for that. As it is, the ETF must stay but you are more than welcome to come back to us when your contract is completed with your current supplier. Regards, Oye
