Statement of Claim
Claimant says:
"My house is 13 tears old. When it was about 10 I noticed that the entire ceiling was cracking and that's a lot of ceiling, I have a 2700 square foot home. I contacted Marlette Homes and they told me the 5 year warrantee was up and they sent me names of a couple guys that would come to fix it on my dime. We didn't have the money so we waited. Spring of 2014 we noticed that there was a big leak in the spare bedroom. We had to cut a hole in the closet ceiling because mobile homes have no attics. It was then we noticed that the ceiling was glued to the support boards, not nailed. We went up on the roof and found a large rotted area so we started taking off the roofing to try and find the source and found they had not put any tar paper at the top of the roof and the leak was coming from there. My husband tripped over the hole in the roof and fell off the roof fracturing his skull. He hasn't been the same since and has been in and out of hospitals. I got on UTUBE and learned how to patch the roof on my own, but now there are large leaks in another bedroom and bathroom and the parts of the ceiling are falling in. I have a lot of pictures and medical records to back up my claim. Check out the mold, that doesn't happen over night"

  • that doesn't surprise me one bit. What you are telling me is you make faulty homes and the faults are hidden so they are not found out until after the warranty is expired. There is an old saying, make one person happy you never hear about it, make one person unhappy and the whole world will know

  • I've had a similar problem with my Marlette home's roof. My home is 12 years old and last year I started with 3 leaks in different areas of my ceilings. I was fortunate enough to have a friend that delivers and sets up double wides. He found faults with the construction of my home. It was missing a section of shingles on the peak, and the vent in my small bathroom was installed improperly.  Also the nail holes that hold down the wooden strips during transport were never filled in.  I blame both Marlette and the mobile home dealer for the leaks. I never thought that I should have had to get up on the roof and inspect my roof when I bought it. And of course the warranty has expired.  I've learned a lesson

  • I've never heard of doing a roof without tar paper. I was always told that the shingles essentially protect the tar paper. Is this standard construction for Marlette Homes?? In my opinion, there are legal obligations (the warranty) and ethical obligations. If it's found that the builder skipped a step (a very important step, as I understand it) then it's unreasonable to say, too bad, you should have caught it sooner, if that's what they're telling you, and judging by your comment, it is. Clayton Homes was apparently sued by FEMA. I would want to ask Marlette Homes and Clayton Homes if there is a reason they apparently didn't use tar paper. I would also ask your Attorney General's office if there are particular construction standards that may apply. Have you asked any other builders about tar paper?
