Statement of Claim
Claimant says:
"I believe that i was wrongfully terminated due to workplace abandonment. The employer is Meisner Electric INC. I had a severe hemorrhoid and the doctor gave me three days off duty, however the doctor's note was written incorrectly, with only two days of time off. The HR Manager called me on the second day asking why I was not at work. I explained that the doctor's note was written incorrectly and that I would have the doctor acknowledge his error and rectify the note. The HR Manager said okay, and also that hemorrhoids are common and that I should have been more responsible in verifying the original doctor's note. The HR manager  then told me that, this is a case of workplace abandonment. The Hr manager then told me that we would have another meeting either over the phone or at work the next day. She then called me back later in the afternoon to say that I have been terminated due to not checking and verifying my doctor's note and explained that  she did not trust my judgement and the ability to perform my job based on how I handled my time off due to not being well. "

  • If the doctor verified that the note should have been written for three days, you might well have a good case.

    Hemorrhoids are usually minor but can become serious, so if your doctor really did write any kind of sick note, I'd suspect that such is the case.

    Hemorrhoids and varicose veins can actually be caused or aggravated by some required tasks. If you can prove that this was the case, you may have a worker's compensation claim as well as an unfair dismissal claim.

    I would suggest gathering your medical records and contacting at least three relevant attorneys in your area. You can also contact your state bar to ask if they can give you a suitable referral.
