Statement of Claim
Claimant says:
"I STARTED WITH METRO MACARTHUR ROAD ON JUNE 26, 2011 AND THE TWO MEN WHO WAITED ON ME WERE VERY HELPFUL. I NEVER HAD ANY PROBLEMS WITH THE COMPANY UNTIL JUNE 26, 2012. ON JUNE 15TH 2012 I ACCIDENTALLY RAN OVER MY PHONE WITH MY CAR. YES, I KNOW I WOULD OF FELT LIKE DYING BUT THE GENTLEMEN FROM METRO TOLD ME THAT IF I ADD METRO BACKUP PLAN FOR A DOLLAR A MONTH I WOULD NOT HAVE TO WORRY ABOUT MY CONTACTS. I WAS SO HAPPY TO HEAR THAT BECAUSE I LOST SOME OF MY MEMORY FROM MY FIBROMYALGIA AND MEDS I NEED TO TAKE. IT MEANT SO MUCH TO ME TO THINK I HAD THIS ON MY PHONE. MY HUSBAND AND I WENT TO LEHIGH VALLEY MALL IN WHITEHALL TO BUY A NEW PHONE ON JUNE 15TH, THE MAN THERE SAID MAYBE YOUR CONTACTS WILL COME BACK ON, WELL THEY DIDNT. I WENT TO 3 OTHER STORES AND THEY COULDN'T HELP ME OR THEY DID A LITTLE TO MY PHONE AND THEN SAID IT WOULD TAKE 24 HOURS UNTIL THEY WENT ON, I WAITED 48 HRS AND NO CONTACTS.SO I WENT BACK TO THE MAN ON MACARTHUR ROAD WHO TOLD ME THIS AND HE THEN SAID TO GO TO THE STORE WHERE YOU BOUGHT THE PHONE AND HE ALSO GAVE ME AN 800 NUMBER WHICH I CALLED AND CONSTANTLY RECEIVED A PHONE MSG. I DID GO BACK TO THE STORE IN THE MALL JUNE 26TH . I MUST OF BEEN THERE FOR OVER AN HOUR , HE DID TRY TO HELP ME BUT COULDN'T. I THEN SAID PLEASE JUST GIVE ME A REFUND SO I CAN GO SOMEWHERE ELSE. MY WHOLE COMPLAINT IS THAT I THINK THAT METRO BACKUP IS NOT CORRECT AND FALSELY USED. I NEVER COMPLAIN , BUT THIS IS SO IMPORTANT TO ME, I WILL NEVER GET THOSE NUMBERS BACK AGAIN, AND I THOUGHT I WAS SAFE . HE TOLD ME HE COULDN'T GIVE ME A REFUND BECAUSE I AM NOT A FIRST TIME USER AND I UPGRADED MY PHONE, HE POINTED OUT ON THE RECEIPT HE GAVE ME. I SAID SIR, WHY WOULD I WANT TO STAY WITH A COMPANY THAT TOLD ME ONE THING AND NOW I AM SCREWED BIG TIME. ALL I WANTED WAS A REFUND FOR MY PHONE SO I COULD GO SOMEWHERE ELSE AND YES PAY MORE BUT HOPEFULLY HAVE PEACE OF MIND. I ALSO ASKED HIM FOR NUMBERS OF THE PRESIDENT AND HIS BOSS , HE SAID HE DIDNT HAVE ANY. I BEGGED THIS MAN."

  • I do have a few questions. It sounds like this was a program/app that was sold to you after you drove over your phone? By my understanding, this is an app that actually must be downloaded onto your phone for the wireless backup of phone numbers to be allowed, so if your phone was already damaged, I'm not sure how the app/program could work in this situation. That being said, if this is my understanding of the app and my understanding of your claim is correct, I'm not sure why this program/app was sold to you when your phone was already damaged, as it seems that a software program would need to be downloaded for this backup system to work.
