Statement of Claim
Claimant says:
"I am a elderly woman and speak Italian, my name is Elsa. I am having my son write this letter for me. I can speak English but cannot write it. I am 80 years old.
We are three elderly family members that booked a cruise with Norwegian after my husband passed away last February 2014. My husband and I were frequent customers over the years with Norwegian. After my husband's passing, as well as a few other family deaths over the last few years, our children pushed us to go away for a break. I suggested to my family we go on a cruise. Therefore my Husband's cousin Angelo and his wife Nina and I booked a cruise.

The cruise liner left NYC on Saturday 7/12/14. On Sunday 7/13/14 , it was "Norwegian night" on the ship so we went to the festivities on board the ship. After dinner while leaving the restaurant , Angelo felt lightheaded. We asked for a chair. The crew called the nurse. He was sent to the infirmary . They said he was dehydrated and placed a I.V in his arm. After a couple of hours Angelo felt better and wanted to return to his room. the ship's Doctor said he was anemic and needed a blood transfusion. Being anemic was never in Angelo's medical history. They insisted he be sent to a Hospital and get a transfusion. On Monday the ship docked at Cape Canaveral. They basically packed us up and called for a ambulance for transport to the Cape Canaveral Hospital. Nina rode with Angelo in the ambulance, I was left alone with baggage, mind you I am 80 years old and speak limited English and had all my baggage as well as Nina and Angelo's luggage too.
Before leaving us the ship's medical staff falsely assured us that if it's nothing we can return to the ship by days end. This was a lie, they knew well enough that the Hospital would need to conduct tests etc. We were left alone, three seniors without any assistance. The basic reason our children felt comfortable with us going on a cruise was that they incorrectly believed that the Cruise ship would watch over us.
During the tests that the Hospital at Cape Caneveral were conducting on Angelo, Nina and I had to find a hotel and transportation to and from the Hospital. That Monday the Cruise ship left port .
After conducting their tests, Cape Canaveral Hospital determined no transfusion was needed, Angelo was not anemic. They also ran other tests and found that dehydration was the cause for that brief dizziness. He was cleared to leave the Hospital and travel via airline or whatever. He was released on Wednesday of that week.
By their abandonment of us three senior citizens we incurred many hardships and costs.
We arranged for transportation back to New York for that Saturday .
It was not a safe situation to leave us by ourselves.
We are seeking reimbursement of all the costs and hardships we had to endure. As well as missing most of our cruise.
We feel that the Norwegian medical staff just wanted to remove us from their ship so that they would not need to deal with anything. They over reacted."

    We will look this situation over and determine our next course of action.
    I am very upset at how Norweigian has conducted itself.

The claimant's settlement terms were rejected with the following explanation:
  • "The guest was medically disembarked as the Doctor onboard felt it was in her best interest to seek medical attention in the United States. This is why the guest was disembarked. A copy of the response letter to the guest is being forwarded under separate cover."
