Statement of Claim
Claimant says:
"I purchased a new desktop computer set that was "serviced" by OfficeMax. It immediately started to freeze. At first I was told by two of their technicians and the Store Manager that this was a "normal symptom" but later indicated that I could avail myself of a "free" inspection. That free inspection cost me $136.42, the problem is worse than before and the Store Manager refused to refund my money. I filed a complaint with the Commonwealth of Virginia Attorney General and later with the BBB."

  • Jan 04, 2013, Claiming party added:
  • Please accept this as a supplement to my complaint that is important.

In my original complaint, I stated that the $136.49 paid to Office Max was supposed to pay for repairs intended to stop the intermittent computer freezes, when, in fact, the problem intensified. A reputable business should refund fees for non-delivery.

I took the computer to Office Depot. They performed a free diagnostic test, found malware and recommended a free site to download. That corrected the problem.

This further supports my claim that Office Max performed an unnecessary and ineffective procedure for which I claim a refund.

  • Jan 05, 2013, Claiming party added:
  • See the attached file. Instead of properly refunding the charge for ineffective service, Office Max chose to reject the claim and attempt to sever my business relationship with them. I do not consider this to be a respoonsible action.

  • Jan 13, 2013, Claiming party added:
  • It is noteworthy, that OfficeMax had two opportunities to service the unit properly - prior to delivery last September, they performed the pre-delivery set up and the second time described in my complaint. Not only did they not service the unit properly and refused the refund, they suggested that I go elsewhere - which I did. I took the computer to Office Depot and it works perfectly. This shows that there is at least one benefit resulting from my Office Max experience - I was referred to Office Depot, my new primary office supply supplier.

  • Some of the recommendations I would have made on this claim you have already followed through on (the complaint with the Attorney General and the BBB). Unfortunately, I also can’t see your additional exhibit as it is blocked on my computer, but this is information I would definitely forward to both entities that you already made a complaint to. In addition to what you have already done, perhaps a letter to the corporation headquarters indicating the representation that a repair was supposed to be free, and the issues that have occurred as a result. Maybe bringing to the attention of someone higher in the company will assist you in getting a resolution.
