Statement of Claim
Claimant says:
"I purchased a directv standard receiver box from what I thought was Radio Shack but was later told after the purchase that it was not Radio Shack it was called Cude Electronics. The receiver purchased was activated at the store by Paul Cude. When I took the receiver home it would not work. I called Directv and was told I needed a filter for my receiver and that the item should be given to me at no charge. When I went back to the store, I told the clerk (Sandra or Sandy the store manager) that my receiver was not working and that I needed a filter according to DirecTV. The clerk shook her head and said, "No", I have never heard of that. I explain what DirecTV had stated and she called Mr. Paul Cude and ask him about a filter. I was told by the clerk that the receiver did not need a filter but if did then it was going to cost me an additional ten dollars but were out of filters at this time. I was told by this clerk that they operated for DirecTV. When I called DirecTV, I was told that they no longer sell receivers to retailers and they were amazed that this store was carrying DirecTV receivers. When I found out I could not get a filter, I asked for a refund and was told that I could not get a refund because the card had already been activated. Then I was told that they did not deal directly with DirecTV but go through a vendor. I spoke to Paul Cude in reference to getting a refund and he stated that I could not get the full amount only half the amount due to the card being activated. Paul Cude wanted me to get a new card through DirecTV and that was the only way he could give me a full refund. When I called DirecTV they said that they did not do that. The clerks conduct first of all was very unprofessional. I was yelled at by the clerk while speaking to DirecTV on the phone stating no one is going to tell her how to do her job. I asked her to stop because I could not hear what was being said by DirecTV representative. I feel that they have illegally represented Directv and refused to give me a full refund. Mr. Cude stated that he could have the receiver installed for an extra charge of $50.00 dollars. I would like to get a full refund back or have the filter given to me like Diretv stated at no charge. I also feel that they should stop the false adverisement claiming Directv representatives. I will highly recommend no to go back to this business back again."

Additional Communication Between Claimant and Paul Cude Hide
  • Feb 01, 2012, Paul Cude (responding party) added:
  • Nancy is not telling the truth. The receiver works like it is supposed to and I tested it in the store, however she admitted that she does not know what type antenna she has and this is needed to run setup at her house. Without running setup the receiver cannot work. I told her she needs a service call to check out her system and run setup, but she refused. I can't guarantee her system at home is working or is set up correctly unless she pays for a service call to fix the problem. All returns must be in new and resellable condion to get a full refund. The receiver has been activated and cannot be resold without a new access card. You cannot get HD from a standard Directv box. It does not need a filter. It worked at the shop without a filter. No one yelled at her. She needs to get her facts straight. She was very argumentative and would not listen to any suggestions about how to make it work. She later said she was going to get Directv to fix her system for free.
