Statement of Claim
Claimant says:
"On September 19, 2015, I had gone online to fill out a form seeking to know the trade in value of my 2013 Toyota, Corolla LE and after filling out part of the information the Priority Toyota Dealership in Chester ad kept popping up. Since I had been cheated y them before, I was very hesitent about doing business with these people. I also thought that the Toyota ad popping up was a mistake so I kept trying to redo the form but still after entering partial information Priority Toyota ad kept popping up. I decided to go ahead and finish filling it out and a salesman called me shortly after. Surely this was like a trap. We did agree to me at Priority that same day and I had found a 2016 Toyota Corolla LE that I liked.THe salesman stressed how they were giving me $14,500 trade in and how a 36 month lease would be good for me since I had traded vehicles so often. What he had explained helped me to decide to purchase a 36 month lease. I had then signed an purchase agreement and left it on his desk. I had waited approximately 5 hours to meet with their finance manager to sign the rest of the paper work agreement and when I was given copies it had shown that I was only getting $12,500 trade in value. The finance manager then called in a black sales manager and then I had explained how I had signed for $14,500 trade in but the manager who had been displaying anger and intimidation toward me had declared that this was all I was being allowed for my trade because my Toyota was only an L series and not an LE. The finance manager the had spoken up and told the angry manager that I was right but the sales manager had become more angry and said he would speak with his managers. He then returned and said I could give the new car back or purchase another type. I had enquired about a 2015 Toyota Corolla and he said they had some but they would cost too much for me since they were a higher series models. So was my trade-in. I had then told him tat I liked the 2016 Toyota and decided to keep it while I was under much distress because I suffer from PTSD, heart disease, terrible migraines, bone disease, depression and could not think clearly. I felt confused and could not fully comprehend what had actually taken place until I had returned home.

During our discussion the salesman had told me that he didn't want someone like me going around giving Priority Toyota nor him a bad rap saying that I hadn't ben treated fairly and how they pretty much demanded that I give them a top 10 rating on the quality of service I had gotten from them. He said he had 9 years in the business and knew what he was doing. As soon as I checked my email that same day there were several emails from Priority and one showed how they were giving anywhere from $3,500 to $3,700 toward the purchase of a new Toyota Corolla 2016 or 2015. In addition I had received an ad during the time just before I had signed for the new car that if anyone who purchased a new car from this Priority Toyota they would get free gas for one year during that weekend when I had purchased the car. I did not see where that was on certain models. The salesman had told me that I didn't qualify because of what I had bought. I certainly would rate this very misleading and false advertising.

When I had first went in to the office to sign papers with the finance manager I had asked him if I was going to be cheated out of another car deal as I had been in 2013 and he chuckled and said, "Of course not because you seem to be a very nice man" During the discussion with him and the sales manager the manager had told me that it was just a matter of my word against theirs just exactly as in 2013 when they had gotten me for $3,000 and had not account what-so-ever on my trade in of a 2013 KIA Sportage all wheel drive. I could hardly believe that this actually happened to me a second time.

Yesterday on 10/17/15 another sales manager had called me because I had replied to one of their emails. I had demanded a copy of my sales agreement that the salesman had refused to send copies of over a week ago and I had complained of reversed racism. HE had become very angry and defied my right to free speech since I had brought up a race issue and then had informed me that I would be hearing from their attorneys. I had made no physical threats in my email to them but he had accused me of doing so.

As I sit here trying to explain my ordeal, I suffer more from very high stress and anguish just thinking of how these kind of people have socked it to me a second time and how I have ad to try to cope with their hostility and threats. I had experienced high blood pressure more than usual just less than a week ago and was fiercely shaking all over, feeling very hot, having speech difficulty, confusion, panic, and could not even fill out a questionnaire at Walgreen's where I had go gone 2 blocks away for help since my themoter didn't work. I ended up taking 4 nitroglycerin tabled and had chewed 4 aspirins trying to get my blood pressure down and ease other symptoms. A pharmacist at Walgreen's had recommended that I go to an emergency room immediately but I didn't want to leave my sick dog alone. Eventually as I would take in slow deep breaths I started feeling better along 3:00 a.m.. I am certain that I had experienced this again that the high stress dealing with how I had been treated by this Toyota place had created so much stress that I couldn't handle it. I am very greatful for Walgreen personnel for treating me very well.

Regardless of the intimidation and threats from personnel at Priority Toyota, I will continue my fight to expose them with hopes for justice and to save others from the misfortune of doing business with these people."

  • Congress needs to pass a bill that will assist disabled veterans who have been cheated by auto dealers. Sales managers who have called the cheated vet making threats due to vets complaints should be held accountable and also the vet has a right to complain of reversed racism at Priority Toyota. They can seek their attorneys on the vets but that doesn't stop this vet because I have rights and I am fed up with liars and those who use threats and intimidation practices. I hope that other vets will contact your congressman and anyone who may be concerned about how veterans are treated when purchasing an auto.

  • I had purchased (leased) my Toyota Corolla on September and have been stolen from, threatened by a sales manager, was refused paper work where the salesman had me sign papers showing that I would receive $14,500.00 trade in for my 2013 Toyota. The salesman refused to send the copy of that agreement, but instead I got a threatening phone call from one of their incompetent sales managers. When I had made efforts to him as how I was cheated our of over $2000,00 he said I kept repeating the past and all of that was now in the past. They only wish! My odometer revealed that I had accumulated over 700 or more miles on the new car and about 5 or 6 days it had dropped to 11.9 as it was when I drove it off the lot. I feel as though it had been tampered with prior to when I had purchased it and underneath there is a knocking or loud rubbing noise .

  • Oct 30, 2015, Claiming party added:
  • A payment representative in Atlanta, GA office had told me 2 weeks ago that my payment date was to be moved up to the first week of November. It had originally had been scheduled for October 19 and sales at Priority said they would take care of that. Well, as no surprise due to their misleading and untruthful information I am now told that I owe for October and November. The lady I had spoken to about 2 weeks ago in Atlanta was very professional and helpful and had reassured me that the new November due date had been made known in my account and that would not effect my credit. I thought I should double check and on October 28th had called Atlanta and had the misfortune of speaking with a lying disrespectful individual who kept interrupting me since I am a white male and her kind only respects the slave crowd as at Priority Toyota in Chester, VA.. They try varying angles to make my life impossible because I am hell bent on exposing Toyota Corp. and exposing them nationwide and locally for fraud and misleading information. IN addition my odometer has dropped from just over 800 miles back to 11.9 miles as it had been when I had driven it off of Priority lot. This car may have been purchased by another misfortunate individual and it was defection and possible had the mileage turned back before I had purchased it There is also a rubbing noise underneath as though something is loose. The mileage is now over 400 miles.

In addition, I continue to suffer extreme health problems worse than before due to high stress from Toyota and this has greatly effected my heart, blood pressure, terrible head pain and spine. I often have more chest pains and shortness of breath not to mention very high stress effecting my nerves and sleep. I wake up during some nights with a feeling of sudden shock to my nerves and body and feeling very depressed. My Priority Toyota experience from the Chester, Virginia has been a terrible nightmare and dealing with their financial office in Atlanta. These are the kind of policies Toyota uses against disabled senior veterans who dispute their misconduct and making threats calling my home. They threatened me with their lawyers so I say to them, "Bring them on Priority Toyota and Headquarters!" The salesman still hasn't sent my signed copy where I agreed to a misleading 3 year lease and for my trade in involving $14,500.00 trade in. Destroying such files is fraud!

  • Mr. Wood was offered a full refund at the time of purchase, he choose not to accept it. He is a Veteran who suffers from PTSD and is not a person we would ever take advantage of. We value all of his service to our country.

  • Nov 05, 2015, Claiming party added:
  • Approximately 2 weeks ago I had called the salesman who had mislead me into a 3 year lease on a 2016 Toyota Corolla Le. The deal sounded very good so I had signed the agreement along with the trade-in value for my Toyota Corolla 2013 LE for the amount of $14,500.00. I had left the document on his desk and had the understanding of the trade-in amount. When I had contacted him about
2 weeks ago I had told him that I needed the agreement that I had signed for of which displayed where I was to receive the $14,500.00 trade in and he said he had that and would send the copies out to me right away. I have never heard from him even after leaving him 3 more messages. If any documents have been destroyed then that is a punishable offense and it's called fraud. The very angry sales manager who was very cowardly about 2 weeks ago kept telling me that I was repeating myself and that all of that was in the past. Well, dude, it is not and Priority Toyota will answer. You people cheated me, not me cheating you or making threats as a coward would by phone.

  • Nov 05, 2015, Claiming party added:
  • Priority Toyota. Due to long term physical and emotional hardship that your dealership and various personnel have unjustly have subjected me to as a 100 % disabled Viet Nam Vet and senior citizen, I feel that a settlement in the amount of $500,000.00 would be a small amount to ask for. You think that PTSD is the only issue? I have news for you and as I have stated you have caused me serious mental and physical anguish and matters need to be settled. I did accept the car after your offer of me giving the new Toyota back but under distress due to anger and intimidation from your sales manager involved and telling me that Priority Toyota and you did not want someone like me going around giving you a bad rap because he had 9 years experience. Also he made the demand that I give Priority and himself a top 10 rating of 10. You people have got to be kidding! I have rights and I will exercise my rights Understand?

  • Nov 09, 2015, Claiming party added:
  • Approximately 4 weeks ago, a sales representative from Priority Toyota had called me in a very angry hostile fashion threatening to seek their attorneys on me. I had kept attempting to explain to this clown how I had been ripped off and had been mislead in the entire car lease deal and trade-in amount. He kept saying that I was repeating myself and how all that was in the past. Well, I think not because I am the victim here and it does appear that this is how Priority does business and takes advantage of customers. I am losing thousands of dollars here and have been subjected to their abuse. Nothing is in the past until I have justice!
