Statement of Claim
Claimant says:
"My mother & I went to Puente Hills Nissan as the result of a mail ad with the possibility of winning a new car. While there we test drove a used pickup they had for $17000.00. The sales department checked my credit & said no. When asked if i had a cosigner my mom said she would as it was my birthday coming up. The sales dept. than said she could get a new truck for the same payments as the used one. Their is a lot more going on with this than I can fit in 10,000 characters, so I will try to get as much in as possible. What it has come down to is this. They pushed a truck on her that was not close to what we told the sales man I wanted. When asked for something else we were told that was the last one in stock. It is a Nissan Frontier 2011 4cyl. with no extras. She is a very trusting person & she is also 86yrs. old but in good health & mentally competent. She is not used to being swindled as she was with this purchase. There was no negotiations on the price & than the finance dept. put $8000.00 worth of add ons making this truck price now almost $29,000.00. The finance dept. took almost 2 1/2 hrs. before calling us in. He put 10 x's on the contract told her to sign them, nothing was explained. She had no idea what she was paying for & than she found out the payment would be $554.00 a mo. When we found out about what the extra $8000.00 covered we tried to get this removed from the contract & was told that the contract was signed & was a done deal. We tried to give the truck back because they sent us a letter saying that they could not find any financing for her & to call the dealer to make arrangements to return the truck. They than told us that it was a computer error & we couldn't return it. We asked about the items we did not want, a maintenance agreement for $2500.00 & service agreement for $1800.00 that we were told we could cancel after 30 days & we found out we had to cancel them before 60 days. We wanted them off the contract so we could get the monthly payment lowered. They wouldn't take them off. Now they say it will come off at the end of the contract. This has put a big stress on both of us but especially my mom. She made a mistake by trusting the sales dept. we both know that now. We have been trying to talk to some one at Nissan Customer Service but can't seem to get anywhere. All we are asking is that they rewrite the contract with a price that anyone else would have gotten had they negotiated with us as they would have with anyone else instead of coning her into thinking they would be truthful, taking off the 2 items totaling $4300.00 that we did not want & most of all a monthly payment that we could handle. This whole thing has put such a stress on both of us that it is making us physically ill. She is worried that her credit will be ruined because we are behind in payments. We need someone to help us work this out as we have no power against Nissan Corp.Please look into this & see if you can find a way to get Nissan to give us a break as a good will gesture or something. Puente Hills Nissan really took advantage of my mom & her trusting nature. Please respond asap because they are already threatening us with repo. We don't think we are being out of line in asking for a fair deal. thank you very much for your time."
