Statement of Claim
Claimant says:
"I purchased a used BMW engine for a BMW 740 IL from Regions after I was told 3 different times by employee Josh that the engine had been checked and was certified to have 41,000 miles on it . After purchasing was told it would be shipped asap within 48 hours it arrived 2 weeks later on a busted skid . It seems to be the way they do business as I have seen after the fact on scam buster and other sites about it . So my repair shop Integrity Auto in Minooka specializes in BMW and Mercedes repair took my old motor out and transferred certain parts over that is normal with engine swaps. also they pulled the spark plugs and they were covered with oil and such which tells you the engine and been flipped over and also a couple parts had been broken too. After the engine was installed Integrity makes a video of the start up just incase of major problems for there own protection but also the customers in a case such as mine. Because at start up there was a tapping sound coming from the timing chain area . At this point I called Regions and talked to Josh and he said oh its not a big deal replace the timing belt as that what are warranty sheet says. I called BMW and asked if there 4.4 e38 engine had 41,000 miles on it would the chains need replacing and they said no that is not normal which tells them the engine has alot more miles on it. That also tells me that Josh nor Region knows anything about BMW engines they kept saying replace the timing belt while BMW has timing Chains on both sides of the engine. And cost 1300 dollars . So at this point I have $2644.00 for motor and $2800.00 for installation now engine has to be pulled and chains replaced and reinstalled another 4000.00 . The more research i do on this company the worse it gets . I think a class action suit is needed as so many working people have had the same problem as I"

  • We notice that our customer is complaining he is nor satisfied with the 2000 BMW engine;we would like to outline our response as follow:
    1.First our customer stated that he paid the engine on NOv 08,2011 and he received on Nov 23,2011,according our terms and conditions non-freight orders approximately ship out within 7 to 15 business days from the day order is placed, we delivered the engine within 15 business days .
    Customer installed the engine and new thermost only, according our terms and conditions customer must follow procedures and requirements to install engines and engine must ne prepared before installation( replace oil,filter, timing belt, water pump and all oil seals( see attached, Regions Auto Parts terms and conditions).Our customer stated that why the timing belt should be replaced on a certified and tested engine BMW engine with 41000 miles, we explained our customer that he must replace timing belt in a used engine in order to honor warranty as stated our terms and conditions.
    We asked our customer to provide service records and receipts to provide proof those conditions were met, all receipts for parts and labor must be presented to Regions in order to honor warranty, customer did not provide them , he did not want to follow procedures and requirements.Engine warranty is voided( see attached, Regions Auto Parts terms and conditions, engines).
    Customer claimed labor costs, according our terms and conditions under no circumstrances is Regions Auto Parts responsible for labor costs performed by third party on parts sold form Regions.Customer waives all claims for consequent damages which result from the sale of any parts form Regions.This includes but not limited to labor charges to install or remove parts by the owner or a third party,loss income,wages or salalry or car rental charges( see attach, Regions Auto Parts terms and conditions,Labor).
    Customer wa fully aware of the general terms of warranty policy and did knowingly agree to the by signing our credit card authorization form ( see attach, credit card authorization form).

  • A certified engine that has been tested should never need $1300.00 in parts and the labor to do so is very expensive and BMW says they would not recommend the replacement of those parts if the said engine only had 41,000 miles . I have video of start up as to protect dealer with these kind of cases . There are so many people out there that have been sold bad engines from these people I will not stop till restitution is made. In court there warranty will not hold up as i have parts proving the miles are not accurate and videos of start up and most of all the voicemails of Josh claiming he has a certified tested 41,000 mile BMW engine. I would settle for $5500.00 if done within 2 weeks if not I will proceed with a lawyer also consider a class action suit as there are numerous people they have defrauded.

  • Also Maria I called Josh and he wanted to get his hands on my video of start up of a engine that was tested and certified by your tech. I have it also oil, filter , seals , thermostat , water pump where changed but if anyone had knowledge there you would know that BMW uses timing chains (more than one)and the parts to do so are 1300.00 and the labor is quite intensive and a engine with 41k (certified) would never need these replaced . When the spark plugs were pulled they were covered in gunk and oil showing engine has more miles than stated so those were replaced a oil sensor which was damaged in shipping cause of crating issues was replaced. I believe in Illnois court that with witnesses this case will be settled in a favorable manor.

  • Mr Brett Bernard never provided proof that he followed procedures and requirements to install the engine , the engine must be prepared before installation ( as stated on our terms and conitions )customer did not prepare the engine to be install , all receipts for parts and labor must be presented to Regions in order to honor warranty( see attached ,credit card authorization form).
    According our terms and conditions indicated mileage can not be guaranteed to measure real part usage ( see attached, credit card authorization).
    According our terms and conditions engine accessories but not limited to such as manifold, oil pan, timing belts and covers,carburatos or fule injection,turbos, starters, air compressors,alternator, power steering pumps, distributos, water pump( including electric),hoses seals, distributor cap,spark plugs,wires and etc are non warranty items on engine purchases unless purchased individually.Please note that these items may or may not be included with engine assemblies.These items will likely need to be replaced entirely or pulled from ypur existing engine( see attached, Regions Auto Parts, terms and conditions,engines).
    Customer was fully aware of the general terms of warranty policy and did knowingly agree to this by signing our credit card authorization form( see attached, credit card authorization form).

  • I believe that the only way to settle this is to bring you to Illnois and drag your employees up there with my evidence no matter what your warranty states and other testimonials of the same thing you have done to innocent people will finally be given justice. Either resolve it the right way and pay the amount of $5500.00 or I have emails from other customer willing to make this happen ! It is so sad how many people have been hurt by your poor business practices ! I am a business owner and have never seen such poor service it's no wonder your BBB is a "F" ! email me if you would like to resolve this ASAP cause I will not stop till restitution takes place ! Thank you
