Statement of Claim
Claimant says:
"To Whom it may concern,

We Have Been Intentionally frauded and Damaged By Royal Gate Dodge. On August 8/19/2016 We agreed to purchase a Dodge 2016 Scat Pack from Royal Gate Dodge. We traded in our 2012 Ram 2500 which we had added a lot of after market additions to the vehicle making the value of our Trade much more valuable than what we were offered for it through Royal Gate Dodge. However, We agreed to purchase a new 2016 challenger Scat Pack based on the interest rate and payment terms and sales price offered to us through Royal Gate Dodge. If the terms would have been different we would have never agreed to the deal to begin with.
When we signed our original contract at Royal Gate Dodge they represented to us that we were required to pay for a number of warranties for the dodge Challenger as a condition for the financing, we had mentioned a number of times that we didn't want the warranties. The finance officer for Royal Gate Dodge told us that the warranties were required to be added as a condition of us getting the financing for the New 2016 Challenger, so we signed the paperwork under durres and prejudice. A few days after we signed the original paperwork we found out that they lied to us and that all the warranty add ons were not a condition of the financing. The finance officer told us to come back in and resign paperwork with the warranties removed. If that wasnt bad enough They back dated the documents to the original purchase date of our purchased the vehicle, which we at the time questioned because we felt the new dates should have been correctly updated reflecting the correct date of purchase. But we signed anyway.
Once we completed the new paperwork and over the next 3 months Royal Gate Dodge kept telling us to bring in more and more paperwork to the point of ridiculousness. But we complied with their requests. As time went on they kept changing the lenders that they were going through to get us the financing.
At the original signing of the paperwork we were represented we were getting a very low interest rate with a payment that we had agreed to and could afford, which was the only reason we agreed to take a lower trade in value for our 2012 RAM 2500. Over the next 3 months Royal Gate Dodge dragged their feet on our loan. We continually asked them for our coupon book so we could start making our payments. Our credit was very important to us and we prided ourselves on being able to purchase anything we wanted at anytime.
At the end of approximately three months Royal Gate Dodge told us that they were unable to get us the loan they represented to us in the original paperwork. They told us they had us approved through a new lender but our payment was not going to be $477.83 as represented but would be going up to almost $900.00. We laughed and told them to just give us back our truck and we would go somewhere else to purchase a vehicle, because we were tired of dealing with them. They told us that they had already sold our Truck and that they couldn't return our vehicle. This infuriated my wife and I because we traded in our truck for far less than it was worth based on all the after market ad on's to our vehicle. We would never have traded in our vehicle if the original contract would have been different. We only agreed to trade in our vehicle based on the terms and conditions at the original time of signing.
Now if that's not enough, once Royal Gate told us they were not going to return our vehicle they told us to bring back the 2016 Challenger Scat Pack or they would report the vehicle stolen. This intentional abuse really stressed out my wife and I, Which Royal Gate Dodge created in our life which we believe was unnecessary and intentional with no regards of how this was affecting us. We did everything they asked. At the time of this mess my wife was 5 months pregnant and I was concerned for our new baby's health due to the stress she was under because of what Royal Gate Dodge was putting here and I under. Since that time and after our child was born he had some health issues after he was born. I truly believe that this indecent contributed to our child's current conditions. Our doctor told both of us that unnecessary duress or stress could in some cases lead to birth defects. As a result of the vehicle transaction we were left with one vehicle while my wife was pregnant. Due to the stress my wife did go into premature labor.
My wife and I are very religious people and we fought within ourselves on what we should do in this matter. After, lots of prayer and soul searching we believe we had to take a stand in this matter so Royal Gate Dodge would never be able to put others through the same fraudulent activity and practices again. Before I forget let me also mention that the finance officer at Royal Gate Dodge tried to talk us into getting my wife's father to fraudulently sign an income verification form with incorrect income being reported. Obviously, my father would not do something that was fraudulent, my father was distraught that they would have even asked him to do that. Obviously, that created great stress in my wife and I as well.
Finally, Royal Gate Dodge told us to bring the 2016 Challenger Scat Pack back and they would give a check for $12,250 dollars which was the difference of the trade in value. We said no to that because our 2012 Dodge Ram 2500 was worth much more than the trade in value they gave us. But because we were so distraught over this whole thing we agreed to picking up the check. But would not release them from liability. Shortly after picking up the check we went to look at other vehicles from other dealerships. It was at this time we realized that Royal Gate Dodge really screwed up our credit. Royal Gate Dodge had ran our credit over 30 times over the 3 months period trying to get a lender to take our loan. The dealerships that ran our credit after we left Royal Gate Dodge told us our credit score was to low to get good financing. So, not only were we intentionally frauded, they also screwed up our credit score. Eliminating us from good financing options.
There are so many other things that happened along the way I have tried to lay out the basic flow of how all of this happened and how much we were harmed as a result of Royal Gate Dodges business practices. This letter is an outline of our intend to sue for an undetermined amount of money. In addition we intend to file criminal charges against all individuals involved in this transaction.
