Statement of Claim
Claimant says:
"My name is Charles Edwards. I work for rue 21 in Anderson South Carolina. I was initially interviewed to become an assistant store manager. I was told during my first interview that they would have no problem accommodating $12 to $13 an hour. About three weeks after I started I was offered a job at EXPRESS. I advised my store manager who then asked me to call our district manager. I did so and she told me that they did not want me to leave the company and to call her tomorrow. I did so from the store phone and she told me to not tell anyone what we were speaking about but she wanted to offer me the store assistant manager posistion. I told her that I would need to think about it. The next day I came to work and told my store manager that I would like to accept the posistion. I went back to EXPRESS and told the store manager thank you but I would've accepting the posistion at Rue 21. Almost two months went by and I asked one of my assistant store managers about what was going on and I was told that my application was lost and I needed to resubmit it. I did so. Then I asked what the status was and was told that information from my first application was different then the first application. My store manager advised me that she had doctored my first application and put what I was making at my old jobs as higher then what they really were. So I resubmitted the application again. After a week or so went by I asked again and was told that the first application said that I had never been terminated but the second said I had been. I emailed my regional and my district manager from the store computer explaining why I had been terminated and also asked about the job and if there would be retro pay available. The next day I had a conference call with Rico the regional manager and Tonya the district manager. He asked her if she ever offered me the position and she said yes. Asked about the pay rate and she said yes. She answered yes to every question concerning my posistion and pay and every communication that we had concerning the job. I advised him that's turned down another job for this one and this was effecting my livelihood. He then told me that everything I was told did not matter and he had the final say on everything involving this job. He then told me if I tell anyone including HR about what we spoke about that we would have to have another conversation. When I asked hm what he meant he alluded to termination. He the said that I have no right to retaliate. I have spoken with two other people who have gone through the same thing almost exactly. Being told one thing and them backing out of what they promised. I contacted an attorney and was told since nothing was ever in writing that I have no leg to stand on. I feel after hearing the same thing happen to two other people and stories from managers from other stores and my store that this happens all the time to people, that something should be done. I do not have the financial resources to take this all the way through the court system. I am sending a copy of this email to Rue 21 cooperate office which I fear will never make it to anyone that can remedy this ongoing problem I am also sending a copy of this to the State of South Carolina's office. This has been happening to people for quite some timeand something has to be done about it. What else can I do to voice my situation and try to make this stop happening to other people? Also I got a job at EXPRESS after all this and am still working at Rue 21 and was told by the store manager that I needed to submit a letter of resignation because working at both places is a conflict of interest. This was told to me after I advised both my assistant store managers at Rue 21 and mentioning that I worked there to my store manager. Can they do this?"
