Statement of Claim
Claimant says:
"I bought a car March 12 2016, I owe 50,000 on this car, and it had 3500 miles on it so it still has full warranty. Well, on Friday March 18 2016 they called from dealship and told us we needed to bring the car in because there was a recall on one of the parts and they were going to replace it. Well I told her I would bring the car in on Monday March 21 2016. Well, I didn't get to take it in because Sunday March 20 2016 the car broke down( it wouldn't start). I called Monday and told them I wouldn't be there because the car wouldn't start so I needed a tow truck and a car. Well, they sent a car and a mechanic but no tow truck. I ask where the tow truck was and he said that they didn't send one because he had brought the part with him. The mechanic told me we were the third person that had trouble with the car and that the car should not have been sold because there was no recall, the car was actually in their service department waiting on the part he brought( the push to start button ) and Wednesday March 16 2016 when the part that had been order before we bought the car came in he went to look for the car and they had sold it. They sold the car to us knowing full and well the car was messed up. I called Rusty Wallace and asked for the general manger Dennis Edwards to tell him we were not happy with the car so we would like our old car back(which they still had ) or we wanted another car. Mr Edwards proceeded to laugh and said "here's what's not going to happen your not getting your car back and your not getting another car." I said "well if you are refusing to help me I guess I will have to contact an attorney" at which time he laughed and said "have your attorney call me". Well 3 weeks later April 13 2016 the car had the same issues so I called Dennis Edwards but he wasn't there, the mechanic mike told me he could send a tow truck but not a car because Dennis Edwards wasn't there to approve it. I told him I had a appointment with a kidney specialist the next day that i had waited 3 monts for and I had to have to have a car. He said he couldn't do it without Dennis Edwards permission. I told him not to send the tow truck without a car. The next morning I called Dennis Edwards and told him I needed a car and a tow truck, his reply was "I'm not sending a car or a tow truck. I sent one last time complementary but you didn't appreciate it so I'm not doing it again". I said "how did we not appreciate it?" He said "because of the comments you made when you rated our business on Facebook" I said "are you kidding me" I wouldn't have made those comments had he not laughed and told me what he wasn't going to do for me. Well he said "you're not getting a car or a tow truck from us". I said "I guess I will go speak to the county attorney today" and he said "see there you go again." I said "what do you mean you are refusing to help me so I have no other choice" he laughed and said "have them call me". Well I called roadside assistance and they towed the car to Rusty Wallace in Morristown (which is 53 miles from my home) and I called mike the mechanic back about getting a car and he said after they diagnose the car If they have to keep overnight, they would send a car. Well the car got to rusty Wallace on Thursday around 5:30pm. The next morning I called at 9:30 and told him I have been without a car for 72 hours I needed a car. He said they were looking at it and he would call back soon. 2 hours later at 11:30 he said he still hadnt diagnosed the car yet and that the battery was charging and it had 13 minutes to go and he would diagnose it and call me back soon. Well I had to call him back at 1:30 and Mike said we are going to have to keep the car, Dennis Edwards approved a loaner car because they would be keeping my car but he said Dennis Edwards refuses to have it brought to me and if I wanted it, I had to come and get it. At which time I told him, I had been without a car for 72hrs and I had no way to come and get it. They said "we'll it's here if you want it but we're not bringing it to you". Can you guys please please help me? I have nowhere to go and nowhere to turn. This is so unfair that people can be treated this way by a business."
