Statement of Claim
Claimant says:
"in September 2004 to April of 2006, I attended the University of Massachusetts in Lowell, Spring 2006 was on plastic and not on Federal Student Loans I filed to late.

I was declared a mental midget by Judge Lynn C. Rooney in 2009, in Discover Bank v. Brett Deveau at the Lowell Courthouse, she scheduled a mental competency hearing for me in Sept 2009.

I was diagnosed with cancer in January 2013. there is no cure for the cancer I have it can kill me and I will be in and out of chemotherapy every few years the rest of my life.

Federal Student Loans sent a legion of credits after me they sent so god damn many they lost track of them. they even write the type of loan I got as unknown.

In 2013, Performant Recovery started docking my social security check for my Federal Student Loans. I had my doctor write me a note and I went to US Senator Warren Office. Shortly after going to US Senator Warren Office they stopped docking my check, my guess is my total and permanent disability argument went through.

Just recently the people at Federal Student Loans came after me again, I tried to fill out the Total and Permanent Disability form again, I was going through chemotherapy at the time and did not know if i could make it into Boston to see Senator Warren so I appealed to US Representatice Tsognus Office at of Lowell.

They started docking my social security check again in January of 2017

Those ^&*( double billed me apparently I was being billed by both Performant Recovery and Nelnet at the same time for 1 college bill. That should violate consumer protection laws. They did not honor the time perido in their own paperwork, they told me I had until January 17, 2017, to fill out the total and permanent disability paperwork which means the earliest my social security check should have gotten docked was next month.

There is (2) different account numbers between Nelnet and Performant Recovery and (2) different amount of money

I want them to what US Senator Warren did for me in 2013, I want them to respect the fact i am disabled and discharge this debt.

I am prepared to argue this in a courtroom I filed in the US District Courts in Boston, see Brett Deveau v. Secretary of the US Department of Education

  • I do not know if the forms I am adding now add to much but they might add readability

    Also I filed against the US Department of Education at the US District Court in Boston, but I would much rather have an Attorney handle that mess for me at 33% pro bono its currently Case No. 1:17-mc-91005-ADB

    After I talked to US Senator Warren the US Department of Education stopped docking my social security check, I thought the matter was over at that point. That was in 2013.

    But the (2) different account numbers the (2) different amounts really leaves a bad taste in my mouth about what the government did to me. Now the US Government is referencing the Performant Recovery account number with the Nelnet amount WTF

  • I do not know how much supporting information you need from me, but when you report something to US Senator Warren Office you get a response back that look like the attached.

    My experience when dealing with Senators is after filling out the attached privacy waiver they are generally pretty helpful. To date I have never heard the word no from a Senator of either party

    1. I was under the impression after listening to Handle on the law with Attorney Bill Handel the Federal Student Loans contract has a disability clause in it, I would love to discuss that

    2. Can you explain why I had (2) different accounts, with (2) different bills on them, there is a difference of nearly $1900 between the Performant Recovery bill and the Nelnet blll?
    3. Where did all the fucking money go that you seized from my social security checks in 2013? the only thing social security says is it went to Performant Recovery, no where in my credit report say payments were being made on that debt
    4. Why did you magical stop docking my social security check in 2013? My guess is its something US Senator Warren did, I do believe she might have got it discharged is that true?
    5. How many collection agencies did you hire to call me around the clock and harass me?

  • Hello people, on Jaunary 19, 2017, the US District Court in Boston granted me the right to proceed without payment today I will be trying to get a copy of that complaint to all relevant parties.

    When I give the US Attorney General Boston his copy as I am required to do by law, I will be filing criminal charges against people who said they represented the defendant. I will be charging the Defendant with violating 18 USC chapter 103, section 2113. I will be arguing the Defendant violated this law but not reporting all the social security money they took from me and did not report to the US Department of Education or any known credit reporting agency.
