"To whom it may concern. My name is Sylvia Rusti. Me and my husband Viorel Rusti moved from California to San Antonio Tx in 2015. Last year we purchased a Property with intention to renovate, and add to the existing structure of the Property, so we may operate an Assisted Living Facility. In order to comply with the City of San Antonio requirements, we hired Engineers, Designers, Architects and etc. Our complaint is against the Civil Engineer, Torres Xavier. We hired him around June 25, 2016, to re-plat the property. He represented him self as a profesional engineer , and that he does this all the time. He said that he is going to start the plans next week, and we can have the plat approved within four months, and there is a way to apply for a plat deferral to even be able to start the building in two weeks. He charged for re-plat 7,500.00, and 2,500.00 for a plat deferral. We talk to the City case manager couple of weeks ago, we were shocked to see that he didn't respond to the comments for re-plat since September 2016, and never responded for plat deferral. He was hired for the Fire Protection Plan arond the same time, and we paid 7,350.00. We called him numerous time, left text messages, and emails, very few times responded. And when he replied back , he lied every single time. Till this day we are not approved for the plans, and we have no words to describe how hard is for us. I'm reaching out for help from you, and hoping that you will solve this problem. I strongly believe that this person should be stopped to practice such a responsible buissenes. The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Requesting a plat deferral from the City of San Antonio is contingent on several factors. One is that the Arborist for the City of San Antonio must approve the plat deferral. To approve the plat deferral, a tree survey must be performed by a surveyor and the tree survey must be reviewed by a Landscape Architect to determine that the property meets the Tree Ordinance. I explained this in great detail to Sylvia and her surveyor and her Landscape Architect. Sylvia's surveyor provided the tree survey several months after it was requested by me. Once the tree survey was completed, Sylvia's Landscape Architect did not provide the information to the City Arborist as requested. Consequentially the City Arborist denied the Plat Deferral. I explained this to Sylvia and I sent her the notice of denial from the City Arborist. I have the receipt from the City of San Antonio proving that I turned in the Plat deferral and I have the email from the City Arborist denying the plat deferral. "
