Claimant says:
"I made a verbal agreement with an employee of this company to have a drainage issue with my lawn resolved. The employee agreed to resolve the problem within two days for the sum of $500.00. He started the job on 4/19/2016. A trench was dug, left open with the dirt and sod removed piled up on my lawn next to the ditch. The trench was approximately 100' long. The contractor left several fittings lying on my lawn at the end of the trench with a length of drain pipe in the ditch. The was no attempt to complete the job for 5 weeks. The fittings and material he left unsecured disappeared. I assumed the contractor picked the material up. I called the contractor and told him I was getting someone else to do the job. There was considerable damage done to my grass due to the dirt being left on my lawn for the 5 weeks. On 5/20/2016 I received an invoice from this company in the amount of $850.00 for material and labor. I told the office manager that I had no intention on paying this invoice and that I thought they picked up the material that was left on the ground. She said they did not pick up the material and that she would send her crew over and dig up the ditch and remove the material used to repair the drainage problem. I told her that I would not allow any of her people on my property and if they became aggressive I would be armed, stand my ground and protect myself and property. The material they abandoned for 5 weeks was probably stolen by one of the construction crews building homes in my community. I feel I am not responsible for this material and any labor the did since the trench collapsed due to rain over the five week period."
