Statement of Claim
Claimant says:
"I purchased a used Toyota Prius from Trust Family Auto Sales in December of 2014. It came with a 3 month 3,000 mile warranty. On the 90th day of ownership multiple dashboard lights lit up. I took it to the dealership the following day since the 90th day was a Sunday and they were closed. They advised me to take it to the local Toyota dealership since my warranty was no longer valid. I explained to them that I had only put 2,200 miles on the car and that they were not open for me to bring it in on the last day of the warranty. They didn't seem to care. So I took it to the local Toyota dealer and had it checked out. It turns out that the car was sold new there and they had extensive service records. The drive battery had one dead cell and one that was weak and dying. They offered to changed out the two cells for $2,400 or replace the battery for $3,000. Of course this upset me. What they told me next really made me mad. The previous owner had already had two cells replaced throughout their ownership. When they traded the car in at Trust Family Auto Sales the salesperson was aware that two cells in the battery were going bad. In fact, the dealership had on record Trust Family Auto Sales brining the Prius in for a diagnosis. The Toyota Dealership recommended to Trust to change the battery before selling the vehicle. Trust decided not to and somehow got the lights to turn off. So 90 days later I am stuck with a car I am making payments on and carrying full coverage insurance on that Trust Family Auto Sales knew was broken. I returned to Trust Family Auto Sales with all the documentation from the dealership in hand. Now they gave me a phone number of a mechanic who had done work for them. I called him and he directed me to purchase two reconditioned cells off of the internet. I did this and spent $150 on both cells and $150 in labor to have them installed. I also had to buy a new starting battery for $179. After he was done I asked him how many Prius batteries he had worked on and he told me that mine was the first one. In fact, he said that Trust Family Auto Sales had called him prior to me calling him and asked him to look up how to do it on the internet. Needless to say that this repair was a waste of money. So I have a 2006 Toyota Prius that I bought and financed through Trust Family Auto Sales that I haven't been able to drive since April of 2015. Further, Trust Family Auto Sales new the car was not right when they sold it to me and offered me a warranty they never intended to stand behind. I would like the car made right or to return the car to them and have them pay off the loan so they can repair and resell it to someone else."
