Claimant says:
"I contacted Home Depot c/o Rick Case Weston Branch. for an estimate on a sun room. The driver of the truck and trailer was advised NOT to enter drive via a small bridge with trailer. The driver stated to my hired-hand that he was a good driver and not to be concerned. Estimate was given. Driver reversed out of driver and damaged a freshly build bridge wall.

Contacted HOme Depot who confirmed that the matter would be taken care of. Home Depot contact Venetian Builders. www.buildwithvenetian.com, michelle.c@veneteianflorida.com, 866-596-2427, fax 866-234-5522. Venetian Builders' General Manager Michelle Castillo, General Manager confirmed the damage and were only prepared to pay $200.00. The estimate to replace the repaired bridge border and made threaten remarks and to accept this measely offer of case closed.

Please help resolve this amicably first before I go to an attorney.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Rosina Bove's bridge rail appears to have been damaged by our trailer wheel striking it on the way out. Fact of the matter is that the rail was nothing more than a piece of fake stonework trim sitting on top on some cinderblocks, of which I have many pictures to show as proof. Rosina has spent the last 2 months harassing my team into rebuilding both sides of her cinderblock railing in an attempt to gain home improvement work for free. We have repaired the railing to its original condition, which again, we have pictures to prove. Given this is nothing more than a foolish attempt to extort work from my company, we will not now, or ever offer any cash settlement. I welcome Rosina to take me to court where all evidence can be reviewed and a decision made by a judge. This would at least give me the opportunity to counter sue her for wasting my time and the time of my employees."
