Statement of Claim
"I WAS CONTACTED BY WOJO HEATING AND COOLING BECAUSE I WAS HAVING PROBLEMS WITH MY WHOLE HOUSE AC IT STOPED WORKING ON 7/25/1956. I HAVE A SERVICE CONTRACT WITH HOME SERVE USA WHO CONTACTED WOJO. WOJO CAME OUT ON 7/27/2016 TOOK SOME METER READINGS TOLD ME MY FAN MOTOR AND A CAOASTER WERE BAD AND THAT HE WOULD CONTACT HOME SERVE TO SEE WHAT HE SHOULD DO. oN JULY 28TH I WAS CONTACTED BY HOME SERVE AND TOLD THAT BECAUSE MY AC UNIT WAS 20 YEARS OLD THAT THEY (WOJO) COULDNT FIND PARTS. HOME SERVE CONTACTED ME AND TOLD ME I WOULD HAVE TO CANCEL MY CONTRACT BECAUSE PARTS WERE NO LONGER AVALIBLE. I GOT OFF THE PHONE MADE ONE PHONE CALL AND FOUND THE PARTS NEEDED TO REPAIR MY AC UNIT. TODAY AUGUST 1ST/2016 I PURCHASED THE PARTS AND MADE THE REPAIR MYSELF IT COST ME A TOTAL OF $150.00. I THINK WOJO AND HOME SERVE USA WERE TRYING TO SELL ME A NEW FURNACE AND AC UNIT BECAUSE I FOUND ALL PARTS NEEDED AND MADE THE REPAIR MYSELF THEY BOTH LIED."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "In your original complaint you stated that "I purchased the parts and made the repair myself", now you are claiming that you had another company make the repair. Regardless of who or when the part was installed, Wojo's heating is not responsible to pay for this repair made by another company. HomeServe contracted us to diagnose the air conditioner. We diagnosed a bad condenser fan motor. Again, we made an error with a model number and were told by an independent distributor that we couldn't get parts. The reimbursement for the money you spent should not come from Wojo's. Why would it? HomeServe would probably work with you, they are a very good company. Things would be much easier if you would talk to someone prior to escalating to this level. It could have easily been solved. If you would have said, that the part was found, we could have called the distributor and found out the problem like we did, but would have been able to be repaired faster and covered under the warranty. Instead you automatically assumed that a reputable company, with an A+ rating with the BBB, and company with great ethics, was trying to "rip you off." I too am a consumer, if I have a challenge with someone I feel did something wrong, I give them the opportunity to correct it, if they refuse, then I would possibly escalate it at that point. The problem is that you didn't give us any opportunity. It is threatening to me when you say that you are going to "ruin' the company I manage. We did try attempt to call you, in fact, it was the owner of the company who tried to call you. We have a digital phone system that tracks incoming and outgoing calls, so if need be, I can give dates, times and length of the call attempting to resolve this issue. Again, I apologize for our error. It was simply that, and error. However, I am not responsible to pay for the repair made to the air conditioner by another contractor. That is between you and your home warranty company. I respectfully ask that you remove this complaint from Wojo's name, as we should no longer be involved in this dispute.
