PeopleClaim's Tools to Help Resolve Disputes:
PeopleClaim offers a robust fully-automated online system that allows you to communicate
complaints and file claims at no charge against businesses, professionals, and others
for the purpose of resolving disputes. You may file three claims per month free
of charge. Optional paid services include:
- Public posting of claims if not resolved 10 days after filing.
- Copying claims to regulators, watchdogs, and media.
- A variety of mail delivery options.
The success of your claim will depend on several factors, including the content
of your complaint and the terms of settlement you propose; successful delivery to
the other party; the person receiving your claim and others who may review it and
decide how to respond; policies and/or laws affecting your case, and any number
of intangibles. With the exception of delivery, where we use our best efforts to
achieve timely completion (but cannot guarantee it), all other factors are outside
our control.
Important: We cannot and do not guarantee results. By filing a claim through
the PeopleClaim system you specifically agree that:
- PeopleClaim does not guarantee your claim will be resolved.
- PeopleClaim's tools, though they may be powerful incentives to resolution, do not
guarantee that your proposed terms or any other terms will be acceptable to the
other party.
- PeopleClaim cannot allow refunds, honor chargebacks, or provide other compensation
for amounts you have spent on paid services when
- your claim is not resolved.
- your claim is resolved outside the PeopleClaim system.
- your claim is resolved quickly and before paid options such as public posting or
sending to regulators has been completed by the system.
Public posting fees are an exception. When you pay for public posting we guarantee
your claim will either be resolved or it will post publicly; and we guarantee a
refund of the fee if the claim is unresolved after 90 days of posting and you apply
for reimbursement within 180 days of its posting date. See Posting Fee Refund Guarantee
below for full details.
If for any reason you believe that we haven't lived up to our services as promised
above, please contact us at support@PeopleClaim.com. We're here to help.
What you can do on this site:
- Recover money or other compensation you believe you're entitled to
- Propose reasonable and good-faith terms of settlement for damages or losses incurred
through an agreement, transaction, or relationship pertaining to your complaint
- Include content such as statements, descriptions, timelines, photos, or recordings
to explain and support your position
- Invite lawyers, professionals, businesses or other PeopleClaim users to review,
comment, or suggest possible resolution options for your complaint
- Use the PeopleClaim Registry to review unresolved claims and evaluate product and
service providers
What you can't do:
- Attempt to recover anything you don't believe you are reasonably entitled to
- Attempt to collect from parties in bankruptcy, in violation of the U.S. Bankruptcy
Code.
- Deliberately cause harm to a business, individual or other entity for malicious
or illegal purposes
- Publicly post another party's private personal information such as Social Security
number, bank account or credit card numbers, passwords, private account numbers,
or certain other confidential information that might reasonably result in identity
theft or other criminal victimization
- Make false or exaggerated statements in order to recover money or other compensation
- Provide false or misleading exhibits such as timelines, photos, or recordings in
support of your claim
- Use an alias or false identity, or misrepresent your role in the circumstances surrounding
your claim
- Use hostile and/or vulgar language in communicating with another party
- Use PeopleClaim to threaten, extort, or coerce
- Violate any state or federal laws
- Receive refunds for ordered services other than public posting fees per the conditions
described below in the section Posting Fee Refund Guarantee, or receive refunds
in the event a claim is removed from the site because of a violation of our Terms
of Use.
- Posting Fee Refund Guarantee
-
We will issue a 100% no-questions-asked refund of your posting fee at your request
if your posted claim is not resolved after 90 days. Requests for refunds will be
honored for days 90 - 180 following the posting date. We cannot refund charges for
Premium services such as postal delivery options or copying claims to regulators,
watchdogs, and media. If you have chosen a reduced price bundle of services, the
posting fee will be refunded proportionately.
Claim posting fees for claims made in error, claims withdrawn prior to posting,
and claims filed through PeopleClaim.com but resolved outside our system (whether
or not use of PeopleClaim was the motivating factor in settlement) are not refundable.
Refunds are processed within two weeks of request. Eligible refunds of public posting
fees must be requested by emailing support@peopleclaim.com. Because the cost of
disputing invalid chargebacks is so high, we regret that if a claimant files a chargeback,
the claim will no longer be eligible for refund.
Note: Upon receiving a request we reserve the right, but not the obligation, to
withdraw any or all publicly posted claim information (concerning your case) from
the PeopleClaim Registry.
- Please review the following specific terms of use prior to using the site.
Note that by using our service you agree to indemnify and hold PeopleClaim harmless
for any unauthorized or illegal use of this site. By using PeopleClaim.com you agree
to the following:
- Terms of Use Supersede Other Communications
- The Terms contained in this Agreement represent the complete statement of our policies
and supersede any statements or communications found in other parts of PeopleClaim.com,
in promotional material, or elsewhere.
- Use Constitutes Acceptance
- Your access to and continued use of this website constitutes your acceptance, without
limitation, of these policies and disclaimers. The following describes the Terms
of Use on which we offer you the information (including the intellectual property),
services and products on our website and related web pages (collectively, the "Services").
We reserve the right to modify, amend, or restate the Terms of Use from time to
time with or without prior notice. Your use of this website and any services will
constitute your acceptance of the Terms of Use as modified. Users are strongly advised
to review the Terms of Use when using the site.
- Use of this Website
- You represent that you have read and agree to be bound by the Terms of Use, including
all limitations of liability included herein. You further agree to comply with U.S.
or other applicable law (including that of your local jurisdiction) regarding the
transmission of any information obtained from the services in accordance with the
Terms of Use; not to use the services for illegal purposes (including spamming or
misrepresentation of yourself or your affiliates); not to use the service to attempt
collection from parties in bankruptcy, in violation of the U.S. Bankruptcy Code;
and not to interfere or disrupt the networks connected to the services.
- Important: Warranties and Limitations on Services Provided
- PeopleClaim offers a low-cost automated complaint resolution process, with robust
communication and negotiation tools, to assist claimants in reaching mutually acceptable
resolutions with third parties. In using the system you understand and agree to
certain limitations:
-
No Guarantee of Results
PeopleClaim cannot guarantee resolution of claims. We also cannot guarantee delivery
of claims: despite best efforts, incorrect addresses, recipient spam filters, refusal
to open or respond to claims, or other factors may prevent communication with the
other party. Users have the option to choose posting a claim publicly as a means
of reaching unresponsive parties, which may or may not succeed in getting a response.
Limitation to Refunds after Filing
PeopleClaim does not provide refunds when claims have been resolved outside the
PeopleClaim system; when a claimant has a change of mind or a claim has been filed
in error; when a claim has been withdrawn after submission; or when a claim has
been removed from the site because of a violation of our Terms of Use. Our Posting
Fee Refund Guarantee described above allows a 100% refund of posting fees only,
for claims unresolved after 90 days. Refer to the Refund section for full details.
Technical and Customer Support Limitations
In general, PeopleClaim cannot respond to requests for changes, updates received
via email, etc., beyond technical support relating to operation of the online system.
We do not offer personal assistance, legal advice, or any other help regarding the
content of your dispute with the other party. Automated support systems allow you
to review, edit, revise terms, and make other changes to your claim. Technical support
and claim-filing help can be requested though Customer Support: support@PeopleClaim.com.
- PeopleClaim Not a Law Firm or Attorney Referral Service
- You hereby acknowledge and agree that PeopleClaim is not a law firm and does not
provide legal services, advice, or assistance in any form. You understand that PeopleClaim
provides self-directed peer-to-peer negotiation and settlement without lawyers,
mediators, or other human intermediaries. You also understand that legal issues
can be complex and require technical expertise and advice from competent legal counsel.
Users are solely responsible for their use of the PeopleClaim negotiation and settlement
system and are encouraged to consult professional counsel for any legal issues relating
to their claims. You understand that PeopleClaim is not an attorney referral service,
though we do provide the option for you to receive inbound communication from attorneys
who may want to inquire about your claim. You are solely responsible for any relationship
you may form with attorneys or other legal advisers who contact you through the
PeopleClaim system. PeopleClaim does not share in attorney fees in any way.
- Claim Content
-
You understand and agree that all content submitted by you including but not limited
to statements of claim, documentation, materials, responses to claims, text, files,
photos, videos, and other content (“Content”), are accurate and honest to the best
of your knowledge and ability. You understand that all Content on PeopleClaim.com
is the sole responsibility of the person from whom the Content originated. You understand
that PeopleClaim does not control and is not responsible for Content produced through
the Claims Process, and that PeopleClaim will not be liable in any way for any Content
or for any loss or damage of any kind incurred as a result of any Content. You acknowledge
that PeopleClaim does not pre-screen or approve Content. As noted below in our Privacy
Policy, PeopleClaim reserves the right but is not obligated to remove posted Content
if it compromises confidential information that might reasonably result in identity
theft or other criminal victimization of any party.
You understand and agree that Content you post is made in good faith to resolve
disputes and not posted for any other purpose, including but not limited to marketing,
promotion, or malicious use or intent. You hold PeopleClaim.com harmless for any
damages resulting from use of PeopleClaim.com, and assume all responsibility and
liability for information and content submitted by you to the claim and/or claim
response.
PeopleClaim is an open service that can be used anywhere in the world. Users bear
sole responsibility for complying with local regulations regarding posting of Internet
content or any other aspect of filing complaints online. Users are strongly advised
to check applicable laws regarding Internet content in their jurisdictions, which
may include the location of the party they are filing against.
- Limitations re Publicly Posted Claims
-
Posted claims are automatically removed from the PeopleClaim Registry after settlement.
Un-posting can also be initiated any time via claimant request through the Account
Center. Though executed by the automated system, un-posting a claim is not instantaneous
and may involve a time lag of 24 hours or more. Claims initiated on PeopleClaim.com
that are resolved outside our system must be reported to PeopleClaim by you (via
the Account Center or your direct request to us) in order to be removed from the
Registry. As a matter of policy, except as provided in the section "Claimant's Obligation
to Communicate," PeopleClaim.com will accept only a request by the claimant or settlement
confirmation by the claimant to unpost a claim. PeopleClaim does not respond to
requests to remove, edit, or review any content posted by claimants, respondents,
or third parties engaged by the claimant who may comment about claims on the site.
The only exceptions are if such action is required by court order; if it is in response
to matters of national security; or, in certain cases, if it is necessary for the
protection of a minor.
You understand and agree we can make no warranty that claims removed from the PeopleClaim
Registry will cease to exist on the Internet. All or part of your claim may remain
accessible in search engine archives, or on any sites that have republished it.
PeopleClaim.com bears no responsibility for any information contained in your posted
claim, or for consequences of the continuing existence of such information on the
Internet after your claim has been removed from the PeopleClaim Registry.
- PeopleClaim Reliability Ratings
- You understand that Reliability Ratings on PeopleClaim's business and professional
profile pages represent our opinion of a business's or other organization's reliability
based on, among other factors, their response to complaints filed by PeopleClaim
users. This rating will be incrementally downgraded to F if the party does not respond
constructively to a posted claim either by accepting settlement terms, making a
counteroffer, or providing a reasonable explanation for non-acceptance. Threatening,
abusive, or other nonconstructive behavior, in attempt to intimidate or otherwise
coerce a claiming party or PeopleClaim to remove, edit, or reposition content, or
change a rating will, at PeopleClaim's sole discretion, result in an F regardless
of the disposition of any outstanding claims.
You further understand that PeopleClaim's
Reliability Rating system is subject to ongoing improvement and that methods and
calculations may change without notice.
- Claims Against Parties in Bankruptcy
- You agree to abide by all relevant restrictions on collections if the party you
are filing against is in bankruptcy. You further understand and agree that in the
event a party you have filed a claim against is in bankruptcy, your PeopleClaim
will be deemed a public notice only and not a collection attempt in violation of
the United States Bankruptcy Code.
- Claimant's Obligation to Communicate
-
The claimant is obligated to respond to the other party's acceptance of terms; to
respond to requests from PeopleClaim to confirm whether claims have been settled
outside the PeopleClaim system, and to confirm edits to claims, changes to contact
or credit card information, or other facts as necessary.
If the Respondent notifies PeopleClaim that the claim has been settled outside the
PeopleClaim system, PeopleClaim may at its discretion request that you confirm settlement
and close the claim. If you notify PeopleClaim that the claim has not been resolved,
it will remain open and, if applicable, publicly posted.
If you do not respond within 10 days, PeopleClaim may, at its discretion, remove
content from the site and/or mark claims resolved and remove them from public posting. You
can reopen a claim at a later date if you do not agree that it has been settled.
PeopleClaim may require you to provide evidence of settlement before removing a
claim from public posting.
- Settlement No Admission of Guilt
- You understand and agree that in using the PeopleClaim system disputing parties
agree that any and all communications including, but not limited to, descriptions
of incidents leading up to claims, claim details or backgrounds, proposed terms
of settlement, and any other communications between the parties conveyed or posted
in the process of filing, responding to, or negotiating a claim, are not in any
way admissions of guilt or liability. Agreement to settle a dispute on PeopleClaim
extends only to the specific terms of settlement and not to other issues communicated
between the parties. Furthermore, by responding to a PeopleClaim offer to settle,
the parties acknowledge NO agreement to any additional statements of the claim beyond
affirmative agreement, if any, to mutually accepted terms of settlement.
- PeopleClaim Resolution and Release of Obligation
- Parties using the PeopleClaim system to resolve disputes understand that agreement
to a claim's Terms of Settlement is binding and that each party agrees to release
the other from further obligation upon fulfillment of the Terms and refrain from
further action in the matter.
- Restrictions on Use
- You may not use the services for any illegal purposes or in any manner inconsistent
with the Terms of Use. You agree to use the services solely for your own noncommercial
use and benefit, and not for resale or other transfer or disposition to, or use

other contractual, statutory or common law rights.

from, transmit, or in any way exploit any part of the service, with this exception:

personal noncommercial use, provided that you retain all copyright and other proprietary

You may not use the services in any way to improve the quality of any data sold
or contributed by you to any third party. Furthermore, you may not use any of our
trademarks, trade names or service marks in any manner which creates the impression
that such names and marks belong to or are associated with you or are used with
our consent, and you acknowledge that you have no ownership rights in and to any
of these names and marks.
You will not use the services or the information contained therein in unsolicited
mailings or spam material. You will not use any of our trademarks, trade names or
service marks in unsolicited mailings or spam material.
You will not spam or send unsolicited mailings to any person or entity using the
services. You agree to comply with any other applicable terms of use.
- Interest Calculation Disclosure
-
PeopleClaim allows you to add interest to the terms of claims. The interest is calculated
based on the standard American compounded interest formula calculated as follows:
The compounded daily rate (CDR) is derived from the interest rate you enter, divided
by 100, divided by 365, plus one; (Interest Rate/100/365) +1. The interest amount
is then derived from the following formula: (Dollars/CDR) raised to the power of
the number of days that interest has been accruing.
By using this system, you agree to hold PeopleClaim harmless for any possible miscalculations
made by our application, problems with our technology, or or yourself. We strongly
advise that you check all interest calculations and also the tax and interest laws
of your jurisdiction (or those with which you are doing business), tax and interest
laws, including standards of business transactions in said localities.

currency, or validity of any information on the website, linked from the website,
or included as an exhibit or attachment on any claim. We have no discretion oversight

of action in contract or tort (including without limitation, negligence or otherwise)
will not exceed the amount you paid us to access the services.
- Important: Unresolved cases may be added to RHUCoin.com
-
PeopleClaim provides the option for unresolved cases to be elevated to a Public Fairness Assessment (PFA)TM on our affiliate site, RHUCoin.com. Claimants can add this option at any time through their PeopleClaim response page.
PeopleClaim may also, at its discretion, elevate unresolved claims to PFAs on RHUCoin in order to facilitate faster resolution. If this happens, you’ll receive an email asking you to review and approve your case details. PeopleClaim may summarize or edit your case for clarity; however, it is your sole responsibility to ensure that all details are accurate.
A PFA is a “Public Verdict.” While it is not legally binding, it is an assessment of the public’s view of the fairness of the case and the possible resolution options. The voting jury could include citizens, industry insiders, legal professionals or other parties Rhucoin deems relevant.
PFAs can be used to help negotiate a settlement, for public validation of your claim, or as supporting testimony in the event a case later goes to a traditional court, arbitration, or other grievance/resolution forum. (Please consult your legal counsel if you have questions about the admissibility of a PFA in traditional legal processes.)

to the services (the "intellectual property Rights") shall, as between you and us,
at all times be and remain the sole and exclusive property of us. All present and
future rights in and title to the services (including the right to exploit the services
and any portions of the services via any present or future technology) are reserved
to us for our exclusive use. Except as specifically permitted by the Terms of Use,
you may not copy or make any use of the services or any portion thereof.
We reserve the right to deny you access to this website and the software, technologies,
and data contained within this website at any time based on our sole discretion.
- Indemnification
- You agree, to the extent permitted by applicable law, to indemnify and hold us,
our officers, directors, owners, agents and employees harmless from any claim or
demand, including reasonable attorneys' fees, made by any third party due to or
arising out of your use of the services, the violation of these Terms of Use by

including but not limited to any misrepresentation of facts. We reserve the right,

subject to indemnification by you.
- Privacy Policy
-
General
PeopleClaim.com operates a secure site, which assures your privacy to the extent
possible within the limits of our applications and technology, and the parts of
the resolution process under our control.
The personal information you provide to establish membership or a user account is
safe from hackers, and employees with access to data are required to keep all user
information strictly confidential. As a matter of policy we do not allow our users'
names and contact information to be rented, sold, loaned, or otherwise disclosed
to any third party for any purpose. We employ stringent security measures to protect
you from loss, alteration, or misuse of information: Your password is stored in
an encrypted form in our user database. No credit card information is retained on
our servers. We monitor security functions on an ongoing basis.
However, we do not control the actions of the parties against whom you file claims,
and cannot be held responsible for how they will use the information you provide
in the claims you file or other information in their possession. Though we withhold
your name and personal data from public posting, certain information you volunteer
in describing your complaint will post publicly if your claim is not resolved. You
control this information. We cannot edit it, and are not responsible for consequences
of anything you have included in your claim if it posts publicly at PeopleClaim.com.
Under certain circumstances we may at our discretion and under no obligation remove
content posted by any party if it compromises another party's Social Security number,
bank account or credit card numbers, passwords, private account numbers, or other
confidential information that might reasonably result in identity theft or other
criminal victimization. You have the option to decline public posting of your unresolved
claims.
Important: Release of Applicable Confidentiality, HIPAA, or Privacy Restrictions.
Claimant hereby grants a limited waiver of applicable confidentiality, privacy,
or HIPAA rights to the responding party, which is limited to the purpose of facilitating
communication necessary to respond to and/or negotiate settlement of this claim.
Specifically, claimant agrees that the responding party has authority and permission
to 1) respond to any questions, statements, or details of this claim in a manner
necessary to provide counter arguments, evidence, or other reasonable support for
any contention, rebuttal, or agreement to assertions made by claimant; or 2) add
clarification or ask questions regarding assertions or claim demands made by claimant;
or 3) provide any other response necessary to address claimant’s issues or demands
as outlined in this claim. Claimant does not however grant permission to release
personally identifying information, including claimant’s or relatives of the claimant’s
names, addresses, account or credit card numbers, protected intellectual property,
private patient records, or other information that could reasonably cause harm if
made publicly available.
PeopleClaim provides both private and public communication channels that allow disputing
parties to communicate either confidentially or publicly in accordance with any
restrictions imposed by prior agreements or regulatory authority. Responding parties
may also request that claimants execute additional and mutually agreeable release
forms to facilitate protection of confidential or private information. Both parties
understand and agree that any waiver or release of rights of privacy or confidentiality
end with mutually-agreed settlement of this claim and that claimant can remove any
waivers granted upon removal of claimant’s publicly posted information from the
PeopleClaim website. PeopleClaim strongly advises both claimants and respondents
to consult their legal counsel with any questions about publicly posting information
that is protected by confidentiality or privacy laws or agreements, including those
protected under HIPAA regulations for healthcare providers.

third-party services, unless otherwise noted. We shall not be liable for any delay
or failure to perform resulting directly or indirectly from any causes beyond our
reasonable control.
